Right to Open Clause Samples

The 'Right to Open' clause grants a party the explicit authority to access, commence, or utilize a property, facility, or system, typically after certain conditions have been met. In practice, this clause may specify the requirements—such as completion of construction, receipt of regulatory approvals, or fulfillment of safety checks—that must be satisfied before the party can begin operations or occupancy. Its core function is to clearly define when and under what circumstances a party is permitted to start using the subject of the agreement, thereby preventing disputes and ensuring both parties understand their rights and obligations regarding commencement of use.
