Device Warranty a. New Devices, End of Life Devices and other equipment, are covered by the manufacturer’s limited warranty, a copy of which is available at the manufacturer’s website.

Device Warranty. 19.1. The warranty from date of purchase lies with the relevant manufacturer for the duration of the implied warranty period, depending on manufacturer and is subject to the manufacturer terms and conditions.
Device Warranty. The oral device you purchased is warranted against defects in workmanship and materials. In the event of unsatisfactory material performance, the repair or complete replacement of the device is covered. Most orthodontic, sleep and splint devices are warranted for 90 days. Cosmetic porcelain/resin restorations, alloy restorations, cast or flexible partial restorations and denture teeth will be warrantied for one years. Denture bases are warrantied for two years. Device Warranties do not include nor apply to cash refunds, temporary replacements, costs incurred for removal or reinsertion, costs incurred by another laboratory, devices that have been previously repaired or altered from new, device damage or ill-fit due to accident, neglect or abuse, supporting bone, tooth or tissue failure, dental changes or improper oral hygiene. To validate the Device Warranty, the following conditions must be met:
Device Warranty. 6.1 Each device is expected to function for a year on the condition that the device remains connected to a UPS (Uninterruptible Power Supply).

HealtheTech will, at its own expense and as its sole obligation and Distributor's exclusive remedy for any breach of this warranty reported to HealtheTech by Distributor in writing during the Device Warranty Period, at its option, repair, replace or otherwise correct any Product that does not conform to the warranty set forth in this Section 10.1, provided that Distributor, at HealtheTech's request and Distributor's expense, returns the nonconforming Product to HealtheTech's plant; and such nonconformity is not the result of any use of the Products other than in strict accordance with HealtheTech's instructions and user manual.

Device Warranty. For a period of ninety (90) days from the date of delivery (the "DEVICE WARRANTY PERIOD"), Supplier warrants that the Devices delivered hereunder will conform to the applicable Specifications, will be manufactured in accordance with the Quality Specifications specified in Exhibit D, and will be free from defects in material, manufacturing and workmanship. Supplier shall, at Buyer's option, promptly provide replacement Manufacturing Services relating to such defective Devices or credit Buyer's account for the amount paid by Buyer for such defective Devices. This warranty shall not apply to Devices which, after delivery to Buyer, have been (i) repaired or altered (except by, or under the direction of, Supplier) or (ii) damaged or subjected to abuse or misuse. Warranty claims hereunder shall be made by Buyer by making a written warranty claim within the Device Warranty Period. Except as otherwise instructed by Supplier, Buyer shall return all defective Devices to Supplier for inspection. Before returning Devices, Buyer shall request in writing and obtain a Return Materials Authorization ("RMA") number from Supplier, and Supplier shall be obligated to review such request and provide the RMA within two (2) business days of receipt of such request, and Buyer agrees to display such RMA number on the packaging of such returned Devices. Replacement Devices will be warranted in accordance with this Section 7.1. THE FOREGOING REPRESENTS BUYER'S SOLE REMEDY AND SUPPLIER'S SOLE LIABILITY IN THE EVENT OF A BREACH OF THE DEVICE WARRANTY IN THIS SECTION 7.1.
Device Warranty. Elemental Machines warrants to Customer that, during the Term, such Device will be free from material defects and will substantially conform to applicable documentation. Device Warranty. Nauto warrants that during the Warranty Period (as defined in the Order, or if not defined in the Order, 12 months from the date of shipment) for a Device, the Device will perform in all material respects in accordance with its specification as in effect on the date of shipment under normal use (within published specifications), given proper installation and maintenance, and subject to the following exclusions and limitations in this Section A5 (the “Device Warranty”). Notwithstanding anything to the contrary (including in an Order), Nauto does not warrant: (i) that the operation of the Devices will be uninterrupted or error-free; (ii) that Devices will meet Customer’s requirements or achieve any business outcome or result; (iii) that Devices will operate in combination with other, non-Nauto products selected by Customer for its use; (iv) that Devices will be free from physical damage, including cracks or scratches on the casing, or damage caused by unauthorized attempts to open, repair, or modify a Device. Nauto will be relieved of its obligations and liability under the Device Warranty to the extent: (a) an error or defect is due to any accessory, equipment, software, or part not manufactured or provided by or on behalf of Nauto; (b) the error or defect is due to the Device having been improperly operated or maintained; (c) the error or defect is due to the Device having been installed by Customer or Nauto Confidential FDA v.3 (12 September 2018) by third parties not engaged, authorized by, and under the control of Nauto; (d) the error or defect is due to the Device having been repaired, altered, or modified by an unauthorized repair facility; (e) the shipment date of the Device cannot be determined due to the Device having had its serial numbers or other identifying marks removed, obliterated, or altered; (f) Customer fails to notify Nauto in writing of the error or defect within the applicable Warranty Period; (g) the error or defect is due to Customer’s or any third party’s misuse, neglect, improper installation or testing, or is due to any other cause beyond the range of the intended use, or is due to accident, fire, lightening, terrorism or other hazard or act of God; or (h) the error or defect in the Device does not exist or was caused by Customer, or any third party.
