Definition of Information. The term “Information” as used in this Agreement includes without limitation any and all information furnished directly or indirectly, either orally, electronically or in writing, by or on behalf of the Company to the Receiving Party and/or its Representatives, and any and all documents regarding Company, its affiliates, subsidiaries, agents, managers, franchisors, the valuation and marketing and sale contemplated herein, and all other information (including such information contained on any computer tapes, computer disks or any other form of electronic or magnetic media, data sites, share sites, Firmex sites and other web based data sharing platforms), whether or not marked “confidential,” that Company or any of its Representatives furnishes or otherwise discloses, whether before or after the date hereof, to Receiving Party or any of its Representatives, together with all notes, analyses, compilations, studies, forecasts, projections, interpretations or other documents, records or data (including information contained on any computer tapes, computer disks, “data sites” or any other form of electronic or magnetic media, share sites, Firmex sites and other web based data sharing platforms) prepared by Receiving Party and/or its Representatives that contain or otherwise reflect or are generated from such documents and information. However, the term “Information” does not include information that (a) becomes generally available to the public other than as a result of a disclosure by Receiving Party or its Representatives in breach of the terms hereof, (b) becomes available to Receiving Party or any of its Representatives on a non-confidential basis from a source other than Company or its Representatives, provided that such source is not known by Receiving Party to be bound by a confidentiality agreement with or other obligation of secrecy to Company with respect to such information, or (c) was or is independently developed by Receiving Party or its Representatives with resources other than Company’s Information .
Definition of Information. For purposes of this Authorization, the term “Information” means information that includes all records about you and your electric service account, including but not limited to your payment records, usage data, electricity usage (AMP) estimates, meter reading dates, service disconnection data, past due payments, billing due dates and amounts, pledges and partial payment agreements, information about your application and eligibility for available weatherization programs, existing third-party notification information, other benefits or subsidies you receive to cover your home heating costs, amounts of other assistance provided, any intake and benefit information from the Program, social security number, driver’s license number, age, date of birth, health information and information relating to disabilities (except for mental health or chemical dependency information from a health care provider), employment information, education level, criminal history, income and financial information and any information collected or generated by the IRS with regard to your tax liability.
Definition of Information. For purposes of this Section, “Information” means all confidential information received from either Borrower or any Guarantor relating to either Borrower, any Guarantor or any Pledged Entity or any of their respective businesses, other than any such information that is available to any Creditor Party or an Affiliate of such Creditor Party on a nonconfidential basis prior to disclosure by either Borrower, any Guarantor or any Pledged Entity, or subsequently becomes available on such basis. Any Person required to maintain the confidentiality of Information as provided in this Section shall be considered to have complied with its obligation to do so if such Person has exercised the same degree of care to maintain the confidentiality of such Information as such Person would accord to its own confidential information.

For the purposes of this Agreement, “Information” shall include, without limitation, all or any part of the corporate, strategic or marketing plans, financial information, product information, customer information, and other information relating to the business of the Company, its affiliates or subsidiaries, all research and development activities, all unpublished know-how, technical data, techniques, records, formulae, process, designs, sketches, photographs, plans, drawings, specifications, samples, reports, studies, findings, inventions and ideas, whether patentable or not, whether they be trade secrets or not and whether they be in written, graphic or oral form, that are now or hereafter owned or acquired by Company, all of which are of a confidential and/or proprietary nature concerning the development, testing, production and marketing of, and consulting in the area of products and processes and technology developed by Company, its affiliates or subsidiaries. Any Information which is communicated to any person external to the Company and/or its affiliates or subsidiaries shall be stamped with the words “PROTECTED” or “CONFIDENTIAL” or other such identifying xxxx xxxxx to its disclosure to such person.
Definition of Information. “Information” shall mean materials, data, or information in any form, whether written, oral, digital, or otherwise, provided by or obtained from Company, Company's agents, or Company's contractors in connection with the Consultant's engagement by Company. Technical or business information of a third person furnished or disclosed to the Consultant under this Agreement shall constitute Information of Company unless otherwise specifically indicated in writing.
Definition of Information. “Information” means “all data, sampling results, studies, reports, evaluations, plans, projects, audits, transcripts, and other Documents derived from or collected under this Agreement.” All Information shall be part of the public domain and shall not be subject to any requirement of confidentiality or non- disclosure, unless such Information is Confidential Information. The Information designated in Appendix B shall not be considered Confidential Information under any circumstances.
