COMMITMENT TO SUPERIOR ENVIRONMENTAL PERFORMANCE. PCA’s Tomahawk Facility has a history of aggressive pollution prevention efforts. PCA is committed to superior Environmental Performance and to achieving measurable or noticeable improvements in Environmental Performance. PCA seeks to achieve a balance among the economic, social and environmental impacts of its efforts to achieve the goals identified below that is acceptable to the Tomahawk, Wisconsin community: • Reduce natural resource usage • Reduce waste generation • Increase recycling • Reduce HAP emissions • Increase employee/community awareness of PCA’s environmental impacts and pollution reduction efforts • Use the targets and goals of the Environmental Management System process to identify opportunities to improve the Facility’s environmental performance • Implement the suggestions of the Interested Persons Group when PCA, WDNR and the Interested Persons Group agree that these suggestions are technically and economically feasible • Continue evaluation of phosphorus treatment and control technologies, process changes and phosphorus minimization steps to reduce the amount of phosphorus discharged to the Wisconsin River to the maximum extent practically achievable taking into account energy, economic and environmental impacts as established in NR 217 of the Wisconsin Administrative Code. Such evaluations may include, but need not be limited to, evaluation of the “Xxxxx process and crystallator” technologies being investigated at Alto Dairy. The limitations of the existing wastewater treatment facility for purposes of maximizing phosphorus removal shall be identified. PCA will report on their evaluations as per Section XIV of this ECA.
COMMITMENT TO SUPERIOR ENVIRONMENTAL PERFORMANCE. Summary 3M agrees to pursue superior environmental performance while achieving a balance between economic, social and environmental impacts from it efforts. The extended Agreement will provide, as anticipated at the time of signature of the original Agreement, further testing of the effectiveness of an Environmental Management System (EMS), designed under ISO 14001 requirements, to identify and find solutions to those aspects of plant operations that have the most significant impacts on the environment. The reduced impacts which were accomplished during the initial 5 year term of this Agreement were driven not only by the plant’s EMS, but also through broad application of the analysis and change methodologies of both Six Sigma and Lean Manufacturing. 3M will continue to expand application of all such tools for the period of this Agreement, such that under the Environmental Cooperation Pilot Program, and in coordination with the facility EMS, 3M commits to pursue and track the following: • Reduce waste (Non Product Output) per pound of good output by 20% by 2010 (2005 baseline) • Sustain or reduce Volatile Organic Compound Air Emissions (VOC) per 1000 pound of good output to less than 7.1 pounds VOC/1000 pound good output (2005 baseline) • Improve Energy Efficiency per pound of good output (with attendant reductions in greenhouse gas emissions) by 20% by the end of 2010 • Accomplish at least two accepted 3P (Pollution Prevention Pays) projects each year through 2010 • Work to certify, improve, and/or protect adjacent 3M properties to those standards established by the Wildlife Habitat Council (WHC) Establish wildlife habitat on the facility site certified by the Wildlife Habitat Council (WHC) According to communications between 3M and WI DNR which occurred during the initial term of the Agreement, 3M has elected to define “good output” more aggressively as finished or semi-finished product only. (This approach provides a lesser credit for emission reductions, and thereby a more challenging goal to attain). Waste, defined as Non-product Output (NPO), thereby includes recycled waste, off-site reuse of materials, waste to energy, and in plant recycle and reuse, in addition to the previous categories of chemical waste, landfill waste, and air emissions. As a component of the initial cooperative agreement, 3M agreed to a substantial reduction in its facility-wide limit of VOC emissions, from over 400 tpy to 249 tpy.   • Environmental Health and Safety Performance Seller acknowledges and accepts full and sole responsibility to maintain an environment, health and safety management system ("EMS") appropriate for its business throughout the performance of this Contract. Buyer expects that Seller’s EMS will promote health and safety, environmental stewardship, and pollution prevention by appropriate source reduction strategies. Seller shall convey the requirement of this clause to its suppliers. Seller shall not deliver Goods that contain any asbestos mineral fibers.

  • ECR Number Environmental Commitment Record Requirements Description of ADOT Responsibilities TMP-3 The following measures will be implemented for the Selected Alternative: • All equipment exhaust systems will be in good working order. Properly designed engine enclosures and intake silencers will be used. • Equipment will be maintained on a regular basis. New equipment will be subject to new product emission standards. • Stationary equipment will be located as far away from sensitive receivers as possible. • Construction-related noise generators will be shielded from noise receivers (e.g., use temporary enclosures to shield generators or crushers, take advantage of site conditions to provide topographic separation). • Construction alerts will be distributed to keep the public informed of construction activities, and a toll-free number for construction-related complaints will be provided. • During the design phase, hours of operation will be evaluated to minimize disruptions during construction. ADOT to oversee for compliance TMP-4 Congestion from construction-related traffic will create temporary impacts in the project vicinity. The magnitude of these impacts will vary depending on the location of the sources of the fill material and of the disposition sites for surplus material, the land uses along the routes, the duration of hauling operations, staging locations, and the construction phasing. To identify acceptable routes and times of operation, ADOT, or its representative, will prepare an agreement with local agencies regarding hauling of construction materials on public streets. ADOT to oversee for compliance TP Attachment 000-0 Xxxxx Xxxxxxxx Xxxxxxx Project Record of Decision (ROD) Developer’s Environmental Commitment Requirements The following table includes the Project-specific environmental commitments as written in the ROD, with minor modifications for clarification purposes. As it relates to these Technical Provisions, references to freeway, project, South Mountain Freeway, proposed action, proposed freeway, and Selected Alternative mean the Project, and references to contractor mean Developer. Developer shall comply with and perform all of the contractor and ADOT requirements, including the ADOT obligations, commitments, and responsibilities, identified in the following table, except to the extent of those requirements that are specifically identified in the third column, entitled “Description of ADOT Responsibilities,” which are not delegated to Developer.

  • Environmental Assessment and Mitigation Development of a transportation project must comply with applicable environmental laws. The party named in article 1, Responsible Parties, under AGREEMENT is responsible for the following:
