Site Closure. Consultant shall remove all Consultant owned materials, equipment and other property and arrange for the removal of all remediation-specific utilities from the Site within sixty (60) days of receipt of PADEP approval of its Remedial Action Completion Report (RACR) or Final Report, as applicable. Consultant shall properly seal and/or abandon all on-site and off-site remediation xxxxx, monitoring xxxxx, borings, trenches, and piping/utility runs and the like as part of corrective action and shall properly dispose of all corrective action related waste in accordance with all applicable requirements within sixty (60) days of receipt of PADEP approval of its RACR or Final Report, as applicable, except for those monitoring points necessary to implement a Post Remediation Care Plan (PRCP). Disruption of the Client’s normal business shall be kept to a minimum. To the extent practical, the Consultant shall return the Site to the condition that existed prior to initiation of the Scope of Work. Conditions prior to initiation of the Scope of Work will be established with detailed site plans and photographic documentation.

Site Closure. If the Sponsor or any member of the IRT determines that a Mitigation Site will not be able to meet performance standards specified in an IRT-approved Mitigation Plan, or that for any reason continued mitigation actions at a Site are impracticable, the Sponsor, the Corps, Ecology, or any member of the IRT may recommend closure of the affected Site. Following a recommendation of closure, the Corps and Ecology, after consultation with the Sponsor and the IRT, shall have the option of closing a Site. The Sponsor, Corps, Ecology, and members of the IRT shall seek consensus on Site closure decisions. If consensus cannot be reached, the Corps’ and Ecology’s determination shall be final.

Site Closure. The Contractor will perform all aspects of site closure in accordance with applicable rules and guidance of the DEP and other government entities. The Contractor is expected to make professional recommendations for a No Further Action closure according to the applicable criteria for Risk Management Options Level I, II, and III in Chapter 62-780, F.A.C. The Contractor will also provide technical details and professional recommendations to support proposed institutional and/or engineering controls. Lastly, the Contractor will facilitate the grouting and abandonment of all borings and xxxxx, draining and capping of all subsurface system conduits, removal of equipment and equipment compounds and other activities associated with returning the site as near as practicable to the conditions that preceded remedial action. Examples of work to be performed under this contract include but are not limited to:

Site Closure. If Customer closes a site where a given unit of Equipment is located, Customer may terminate Equipment Maintenance Service coverage for such unit of Equipment if (a) Customer has paid for at least twelve (12) months of Equipment Maintenance Service for such unit of Equipment, (b) Customer does not relocate such unit of Equipment to another site, and (c) Customer gives Fujitsu at least ninety (90) days prior written notice. In such an event Customer shall be given a pro-rated refund of the applicable pre-paid Maintenance Service charges.

Site Closure. Associates acknowledges that the Property, and/or portions thereof, may require a Site Closure Certification in order to implement the Short Term Amendment to Lease and the surrender of the Property by WJ and/or Stellex pursuant thereto. WJ, shall take all action required to obtain such Site Closure Certification, if so required, prior to the expiration of the term of the Short Term Amendment to Lease. If WJ determines that a Site Closure Certification is not so required, WJ shall deliver evidence reasonably satisfactory to Associates that a Site Closure Certification is not so required. For purposes of this paragraph, a letter signed by Consultant delivered to Associates and to the Certifying Agency certifying that a Site Closure Certification is not required in order to implement the Short Term Amendment to Lease and the surrender of the Property by WJ and/or Steeled pursuant thereto shall be deemed satisfactory to Associates.
