Chemical Control. Glyphosate (Roundup and Rodeo) has been used with some success on Ammophila, although its effectiveness is dependent on consistency and thoroughness. A label recommendation of 8% Rodeo plus 0.5 to 1.5%nonionic surfactant (spray-to-wet) was developed for Oregon, Washington, and California following trials by the California Department of Parks and Recreation, the Oregon Department of Fish and Wildlife, and the Monsanto Company. Rodeo, a form of glyphosate without surfactant, was preferred in Oregon because of concerns about groundwater contamination. Rodeo is approved for aquatic use because it lacks the polyethoxylated tallowarnine present in the surfactant in Roundup. The label also recommends wiper applications for selective control, using a 33% solution plus 1.0 to 2.5% nonionic surfactant and avoiding contact with desirable vegetation. For either method, plants should be treated during periods of active growth. The use of Roundup to control Ammophila was tested extensively by the California Department of Parks and Recreation and the University of California Davis at several California dune systems. Although results have not been published, the investigator reports good success using a 10% solution with added surfactant (0.5%) (Xxxxxxx, pers. comm.). Since these experiments were carried out, the surfactant in Roundup has been reformulated by Monsanto, which recommends no additional surfactant be added to Roundup-Pro or Roundup-Ultra (McColly, pers. comm.). Herbicides have been used on Ammophila most extensively at the Oregon Dunes National Recreation Area. In 1996-1997 about 60 acres of Ammophila were sprayed with an 8% solution of Rodeo (with surfactant) at Tahkenitch and Ten Mile dunes. In the first year only one application was used. Results were inconsistent, with some areas clearly missed. However, overall density and cover was significantly reduced (Xxxxxxx, pers. comm). In the second year (1997), missed areas were resprayed, and new areas were given two applications, but results are not yet available. Chemical treatment of Animophila is likely to be the most cost-effective method of those used to date. There are, however, problems with this method. Chemical Control. Contractor shall comply with all rules and regulations of the Department of Food and Agriculture, the State Department of Health Services, and all other agencies which govern the use and application of chemicals required in the performance of the work to be provided pursuant to this Agreement. The term “chemicals” shall include but not limited to; fertilizers, herbicides, insecticides, fungicides, rodenticides, germicides, nematicides, bactericides, inhibitors, fumigants, defoliants, desiccants, soil sterilants and repellants. Contractor shall apply spray chemicals when air currents are still, preventing drifting onto adjoining property whether they are in, or near, the project. The Contractor shall submit a list of all chemical fertilizers, herbicides or pesticides proposed for use under this contract for approval by the Parks Supervisor. Contractor shall submit a schedule to the Contract Officer outlining date, location, and chemical type/analysis to be performed at least fifteen (15) days prior to the week of work. Said schedule must be approved by the Contract Officer before the work is undertaken. A pollution prevention plan shall be developed within the first sixty (60) days of execution of this Agreement to maintain compliance with industry best management practices for pollution prevention.
Chemical Control. ‌ Chemicals have been used by many natural resource professionals to achieve specific habitat management goals and objectives. Currently, many land managers use herbicides because of their effectiveness, ease of use and because herbicides can be relatively inexpensive. Although herbicide use may be an effective habitat management tool, a paucity of research exists on the effects of chemicals on reptiles and, specifically, to EMR. Therefore, it is strongly recommended that land managers consider specific biological factors and utilize a cautious approach when choosing an herbicide, application method, application rate, time of application, and time between applications. Due to the unknown impacts of herbicides to EMR, broadcast applications in Managed Land is prohibited except when land managers are re-establishing suitable habitat at highly degraded sites (e.g. converting row crops to native grasslands or to control monocultures of invasive species). Land managers may use other herbicide treatments such as spot spraying or wicking to control invasive plant species in Managed Land.
Chemical Control. Contractor shall comply with all rules and regulations of the Occupational Safety and Health Administration, and all other state or and local agencies which govern the use and application of chemicals required in the performance of the work to be provided pursuant to this Agreement. The term “chemicals” shall include but is not limited to; any solution, liquid, compound, or powder used for the purpose of cleaning, disinfecting, neutralizing odor, removing residues or gum, or removing paint on bathroom facilities and park amenities. The Contractor shall submit a list of all chemicals proposed for use under this contract for approval by the Parks Services Manager.
Chemical Control. No chemical controls on Commission Property are granted by this License.

  • TOXIC SUBSTANCES Each Contractor furnishing a toxic substance as defined by Section 875 of the Labor Law, shall provide such Authorized User with not less than two copies of a material safety data sheet, which sheet shall include for each such substance the information outlined in Section 876 of the Labor Law. Before any chemical product is used or applied on or in any building, a copy of the product label and Material Safety Data Sheet must be provided to and approved by the Authorized User agency representative.

  • Controlled Substance Bodily injury" or "property damage" arising out of the use, sale, manufacture, delivery, transfer or possession by any person of a Controlled Substance as defined by the Federal Food and Drug Law at 21 U.S.C.A. Sections 811 and 812. Controlled Substances include but are not limited to cocaine, LSD, marijuana and all nar- cotic drugs. However, this exclusion does not apply to the legitimate use of prescription drugs by a person following the orders of a licensed physician.

  • SUBSTANCE ABUSE The dangers and costs that alcohol and other chemical abuses can create in the electrical contracting industry in terms of safety and productivity are significant. The parties to this Agreement resolve to combat chemical abuse in any form and agree that, to be effective, programs to eliminate substance abuse and impairment should contain a strong rehabilitation component. The local parties recognize that the implementation of a drug and alcohol policy and program must be subject to all applicable federal, state, and local laws and regulations. Such policies and programs must also be administered in accordance with accepted scientific principles, and must incorporate procedural safeguards to ensure fairness in application and protection of legitimate interests of privacy and confidentiality. To provide a drug-free workforce for the Electrical Construction Industry, each IBEW local union and NECA chapter shall implement an area-wide Substance Abuse Testing Policy. The policy shall include minimum standards as required by the IBEW and NECA. Should any of the required minimum standards fail to comply with federal, state, and/or local laws and regulations, they shall be modified by the local union and chapter to meet the requirements of those laws and regulations.

  • Substance Abuse Program The SFMTA General Manager or designee will manage all aspects of the FTA-mandated Substance Abuse Program. He/she shall have appointing and removal authority over all personnel working for the Substance Abuse Program personnel, and shall be responsible for the supervision of the SAP.

  • Hazardous Waste Throughout the term of this Lease, Tenant shall not undertake or permit any Environmental Activity (as such term is hereinafter defined) other than (i) in compliance with all applicable laws and ordinances and all rules, orders and regulations, present or future, ordinary or extraordinary, foreseen or unforeseen) of any federal, state or local governmental authority (hereinafter collectively referred to as "Legal Requirements"), and (ii) in such a manner as shall keep the premises, the Building and the Land free from any lien imposed pursuant to any Legal Requirement in respect of such Environmental Activity. Tenant shall take all necessary steps to ensure that any Environmental Activity undertaken or permitted at the premises is undertaken in a manner as to provide prudent safeguards against potential risks to human health or the environment. Tenant shall notify Landlord within 24 hours of the release of any Hazardous Materials (as such term is hereinafter defined) from or at the premises which could form the basis of any claim, demand or action by any party. Landlord shall have the right, from time to time, at Tenant's expense, to conduct an environmental audit or such other examinations, tests, inspections and reviews of the premises as Landlord, in its sole discretion, shall deem necessary, appropriate or desirable and Tenant shall cooperate in the conduct of any such environmental audit, examination, test, inspection or review. If Tenant shall breach the covenants provided in this Article, then, in addition to any other rights and remedies which may be available to landlord pursuant to this Lease or otherwise at law, Landlord may require Tenant to take all actions, or to reimburse Landlord for the costs of any and all actions taken by Landlord, as are necessary, appropriate or desirable to cure such breach. for purposes of this Article, the term "Environmental Activity" means any use, storage, installation, existence, release, threatened release, discharge, generation, abatement, removal, disposal, handling or transportation from, under, into or on the leased premises of (a) any "hazardous substance" as defined in any federal statute, (b) petroleum, crude oil or any fraction thereof, natural gas or synthetic gas used for fuel, and (c) any additional substances or materials which at such time are classified or considered to be hazardous or toxic under the laws of the State of New York or any other Legal Requirements the materials described in clauses (a) through (c) being collectively referred to as "Hazardous Materials". The provisions of subparagraph (j) of Article 6 of this Lease shall be applicable to any failure by Tenant to comply with or keep or perform the provisions of this Article. The obligations of Tenant under this Article shall survive the expiration or sooner termination of the term of this Lease.

  • Quality Control A. Controlled Affiliate agrees to use the Licensed Marks and Name only in connection with the licensed services and further agrees to be bound by the conditions regarding quality control shown in attached Exhibit A as they may be amended by BCBSA from time-to-time.

  • Environmental Monitoring (a) Borrower shall give prompt written notice to Lender of (i) any proceeding or inquiry by any party (including any Governmental Authority) with respect to the presence of any Hazardous Substance on, under, from or about the Property, (ii) all claims made or threatened by any third party (including any Governmental Authority) against Borrower or the Property or any party occupying the Property relating to any loss or injury resulting from any Hazardous Substance, and (iii) Borrower’s discovery of any occurrence or condition on any real property adjoining or in the vicinity of the Property that could cause the Property to be subject to any investigation or cleanup pursuant to any Environmental Law. Upon becoming aware of the presence of mold or fungus at the Property, Borrower shall (i) undertake an investigation to identify the source(s) of such mold or fungus and shall develop and implement an appropriate remediation plan to eliminate the presence of any Toxic Mold, (ii) perform or cause to be performed all acts reasonably necessary for the remediation of any Toxic Mold (including taking any action necessary to clean and disinfect any portions of the Property affected by Toxic Mold, including providing any necessary moisture control systems at the Property), and (iii) provide evidence reasonably satisfactory to Lender of the foregoing. Borrower shall permit Lender to join and participate in, as a party if it so elects, any legal or administrative proceedings or other actions initiated with respect to the Property in connection with any Environmental Law or Hazardous Substance, and Borrower shall pay all reasonable attorneys’ fees and disbursements incurred by Lender in connection therewith.

  • Musculoskeletal Injury Prevention and Control (a) The Hospital in consultation with the Joint Health and Safety Committee (JHSC) shall develop, establish and put into effect, musculoskeletal prevention and control measures, procedures, practices and training for the health and safety of employees.
