The Southern. Sudan Land Commission shall have its budget approved by the Government of Southern Sudan and shall be accountable to the President of the Government of Southern Sudan for the due performance of its functions.
The Southern. Sudan Land Commission shall apply the law applicable in the locality where the land is situated or such other law as the Parties to the arbitration agree, including principles of equity.
The Southern. Sudan Land Commission may conduct hearings and formulate its own rules of procedure.
The Southern. Sudan Land Commission shall be representative and independent. The composition of the membership and terms of appointment of the Southern Sudan Land Commission shall be set by the legislation constituting it. The Chairperson of the Southern Sudan Land Commission shall be appointed by the President of the Government of Southern Sudan.
The Southern. NABTU LMCC, upon the approval and direction of its Trustees, shall be used: (i) to promote social justice and racial and gender diversity programs, including but not limited to the promotion of apprenticeship readiness programs for underserved communities, with two cents ($.02) of the four cents ($.04) per hour contribution set forth above in Section 6(b) earmarked for such purposes; and to promote and support programs and activities designed to attract personnel leaving the military and veterans for careers in the construction industry to help provide necessary personnel for Contractors, with two cents ($.02) of the four cents ($.04) per hour contribution set forth above in Section 6(b) earmarked for such purposes.
The Southern. NABTU LMCC, upon the approval and direction of its Trustees, shall use these funds for approved programs and expenses including, but not limited to: (1) Social justice, racial & gender diversity programs (2) Apprenticeship Readiness Programs;
The Southern. NABTU LMCC shall function in accordance with the Agreement and Declaration of Trust creating the fund, any amendments thereto, and any other of its governing documents. Each Contractor performing work covered by this Agreement approves and consents to the appointment of the Trustees designated pursuant to the Trust Agreement establishing the Southern- NABTU LMCC.

  • The Service 1.1 Subject to your compliance with this Agreement and your timely meeting of the financial terms, including payment of the applicable subscription fees and charges you agreed to in writing with NCR Voyix or with a Reseller, NCR Voyix authorizes you to access the Service for your internal use on your own behalf and not for the benefit of any third party during the Term as set forth on an Order Form and authorized by NCR Voyix (“Licensed Site(s)”). This access right is non-exclusive and non-transferable and will end when this Agreement expires, is terminated or cancelled. NCR Voyix may cancel this Agreement and the Service in accordance with the terms set forth in this Agreement even if you purchase Products through a Reseller. In order to maintain reasonable production data storage requirements and to ensure proper performance of the Service, NCR Voyix may implement, in its sole discretion, limited data archival policies and procedures including periodic data purging of the hardware, software, or other systems NCR Voyix uses to provide the Service.

  • Settling of Grievances An xxxxxxx effort shall be made to process and settle grievances fairly and promptly in the following manner: It is agreed that an Employee has no grievance until he/she has first given his/her immediate Supervisor an opportunity to adjust his/her complaint within fourteen (14) calendar days of its occurrence or when they ought to have become aware of it. The Employee may request to meet with their Supervisor and is permitted to have a co-worker from their department present at the meeting. Prior approval is required to attend the meeting. The Employee has the option of making a written submission as an alternative to the meeting. The Employer will provide a written response to the complaint and if no satisfactory answer is received within seven (7) calendar days from the time it was first discussed with the Employee’s immediate Supervisor, the Employee may proceed to Step 1 of the grievance procedure. Step 1 Failing satisfactory settlement at the complaint stage the Union may present the grievance to the appropriate Supervisor within seven (7) calendar days following the decision at the complaint stage. The grievance shall be in writing on a mutually approved form and shall include the nature of the grievance, the redress sought and the section or sections of the agreement that are alleged to have been violated. The Supervisor shall deliver his/her decision in writing within seven (7) calendar days following the presentation of the grievance to him/her. Step 2 Failing satisfactory settlement at Step 1, the Union may present the grievance to the Administrator, or designate, in writing within seven (7) calendar days following receipt of the decision at Step 1. A meeting will be held within seven (7) calendar days from receipt of the grievance between the Administrator, or designate, and the Union. The decision of the Administrator, or designate, shall be delivered in writing within seven (7) calendar days of the meeting. Step 3 Failing satisfactory settlement at Step 2, either party may refer the grievance to arbitration within thirty (30) calendar days following receipt of the decision at Step 2.
