Substance Abuse Program. The Parties to this PLA recognize the need to provide a drug-free and alcohol-free workplace. In order to produce as safe a workplace as possible, it is understood and agreed that the Parties abide by the rules and provisions of the mutually agreed upon substance abuse program includes the following types of testing: pre-employment, reasonable suspicion, post-accident, random, and return-to-work. The Port’s Substance Abuse Coordinator (Coordinator) will retain oversight over the program and the approved Substance Abuse Program Administrator (Administrator) will administer the testing program and testing services for the entire labor force identified in this PLA. All testing will be conducted only by laboratories under the strictest federal guidelines, with special provision to assure test reliability, employee privacy, and confidentiality. All testing will be conducted only by laboratories approved by the Substance Abuse and Mental Health Services Administration (SAMHSA) in accordance with the Mandatory Guidelines for Federal Workplace Testing Programs established by the U.S. Department of Health and Human Services, as amended. Any disputes under this Program shall be subject to the grievance procedure, Article 7. Substance Abuse Program is available upon request. Substance Abuse Program. 26.1 The Substance Abuse Policy prohibits employees from reporting to work under the influence of alcohol or drugs, exhibiting symptoms of alcohol or drug use, using, possessing, selling or providing drugs or alcohol while on duty, and employees shall not have the ability to work or be on paid standby when impaired as a result of the use of alcohol or drugs. Additionally, employees are required to notify their supervisor when any medication or drug they are taking could create an unsafe and dangerous situation. Employees may be requested to submit to a drug and/or alcohol analysis when there is reasonable suspicion that an employee is intoxicated or under the influence of drugs or alcohol. Employees represented by the Association shall comply with the City’s Substance Abuse Policy.

Substance Abuse Program. 32.01 The Township’s program for substance abuse is attached as Appendix A to this Agreement and is fully incorporated as if written herein. The Township reserves the right to modify the substance abuse program to address Bureau of Workers’ Compensation changes and to add additional drugs, known to be abused, for testing. In the event the Township intends to modify the policy for these purposes, it shall provide the Union with at least 45 days advance notice of its intention and reasons for making such changes.
Substance Abuse Program i. Alcoholism and drug abuse are recognized by the Committee and the Association to be treatable illnesses.
