Supervision of Construction. The Recipient agrees to maintain competent and adequate engineering supervision at the construction site of any Project to ensure that the completed work conforms to the approved plans and specifications.
Supervision of Construction. Developer retains overall responsibility for the Project; subject to this retention, Developer may delegate supervision duties over the construction of all Public Improvements and Public Infrastructure, and cause said construction to be performed, at a minimum, in accordance with all legal requirements detailed in Section 6.2 above, the City Code, and the plans and specifications approved by the appropriate City department, notwithstanding any other provision of this Agreement. The legal requirements set forth in Prevailing Wage, Chapter 2258 of the Texas Government Code shall apply to work on the Project paid for with TIF funds.
Supervision of Construction. Contractor shall be solely responsible for and shall supervise and direct all construction under this Agreement. Contractor shall provide competent and suitable personnel to perform the Work and shall at all times maintain good discipline and order at the Property. Contractor will at all times take all reasonable precautions for the safety of its employees and the public at the Property. Contractor agrees to assume full responsibility for the acts, negligence, and/or omissions of its employees and any subcontractors and their employees.
Supervision of Construction. (i) Manager shall use commercially reasonable efforts to manage, supervise, oversee and facilitate all repairs, construction, maintenance, replacements, substitutions, improvements, additions and alterations, including, without limitation, Tenant improvements at the Properties, contemplated by the Approved Annual Business Plan and Budget (collectively, “Construction Work”).

The City agrees to cause the performance of all construction of all Public Infrastructure and Public Improvements, at a minimum, in accordance with all Federal, State and local laws, including, but not limited to the current TIF Guidelines, the Unified Development Code, Universal Design, Prevailing Wage, Chapter 2258 of the Texas Government Code, the City Code, and the plans and specifications approved by the appropriate department of the City. The City also agrees to provide reports including inspections of such construction and of compliance with such laws, ordinances, and contractual requirements. 5.7 Reserved.

Notwithstanding any other provision of this Agreement, Developer agrees to retain and exercise supervision over the construction of all improvements of the Project, and cause the construction of all public infrastructure and public improvements to be performed, at a minimum, in accordance with all federal, state, and local laws, including, but not limited to the Unified Development Code, Universal Design, Prevailing Wage, Chapter 2258 of the Texas Government Code, the City Code, and the plans and specifications approved by the appropriate City department. The Developer shall maintain and make available for inspection Payment bonds with copies to the City’s TIF Unit. Without limiting other material breaches, failure of the developer to ensure the compliance of its contractor(s) with this section or Chapter 2253 of the Texas Government Code is a material breach of this Agreement, and the City may exercise the full range of legal remedies available to the City, including but not limited to: terminating this Agreement and/or exercising its rights in accordance with Article XI herein.
Supervision of Construction. 24. The construction and installation of the Phase III Works shall be carried out under the full- time supervision of the Subdivider’s Engineers, subject to the rights of the Municipality and of the Municipal Engineer under this Agreement; provided, however, that the exercise of such rights by the Municipality or by the Municipal Engineer shall not relieve the Subdivider of responsibilities for any errors or omissions or from the Subdivider’s obligation to construct, install and maintain the Phase III Works in a good workmanlike and complete manner and in accordance with this Agreement.

Supervision of Construction. City shall be under no obligation to perform any of the construction or complete the construction of the improvements on the Property, or to supervise any construction on the Property, and shall not be responsible for inadequate or deficient contractors, subcontractors, materials, equipment or supplies. City is not the agent for Borrower, neither are City and Borrower partners or joint venturers with each other.
