Real Estate Investments definition

Real Estate Investments means direct or indirect equity investments by the Fund in all forms in Real Estate, and shall exclude investments in Mortgage Loans as well as any investments in Mortgage Loans characterized as equity investments for financial accounting purposes.
Real Estate Investments means any Investments related to acquisitions or developments of real estate (owned by the Group, the Guarantor's company group or the Joint Venture Companies); also including Investments in the Subsidiary Index Energy Road Mills Corporation’s steam plant in Ajax, Canada.
Real Estate Investments means: (i) direct or indirect ownership of real property, where real property is the freehold, leasehold, strata, and undivided interests, benefits, and rights inherent in the ownership of real estate. Real estate means land, buildings, and other affixed improvements that are found upon the land, in addition to all leases and contracts associated with the land and buildings; and (ii) any other allowable investments of the Fund.

Real Estate Investments means investments in real estate assets or interests in any Person (as defined in Condition 3) directly or indirectly holding such assets.Promptly upon the Issuer becoming aware that an Asset Sale Put Event has occurred, the Issuer shall give notice (an “Asset Sale Put Event Notice“) to the Noteholders in accordance with Condition 15 specifying the nature of the Asset Sale Put Event and the circumstances giving rise to it and the procedure for exercising the Asset Sale Put Option contained in this Condition 5(f).To exercise the Asset Sale Put Option, a Noteholder must transfer or cause to be transferred its Notes to be so redeemed or purchased to the account of the Principal Paying Agent specified in the Asset Sale Put Option Notice (as defined below) for the account of the Issuer within the period (the “Asset Sale Put Period“) of 45 days after an Asset Sale Put Event Notice is given together with a duly signed and completed notice of exercise in the then current form obtainable from the Principal Paying Agent (an “Asset Sale Put Option Notice“) and in which the Noteholder may specify a bank account to which payment is to be made under this Condition 5(f).An Asset Sale Put Option Notice once given shall be irrevocable. Real Estate Investments means investments primarily in HGI Opportunity Fund XV, LP (“HGI”) managed by its general partner HGI Opportunity Fund XV GP, LP (“HGI GP”), as well as investments in other opportunity funds with similar investment strategies to HGI (“Other Real Estate Funds”), and short-term commercial lending transactions in the real estate asset class originated by affiliates of the Fund or by third party lenders.
