Reporting of Accidents of Labour: - The Contractor shall be responsible for the safety of all employees directly or through petty contractors or sub- contractor employed by him on the works and shall report serious accidents to any of them however and wherever occurring on the works to the Engineer or the Engineers Representative and shall made every arrangements to render all possible assistance.
The provision, storage, transport, use, handling, distribution and maintenance of all consumable stores fuel, water and electricity including the requirements of the Engineer's Representative and his staff.
The Engineer or the Engineer's Representative shall be entitled to take possession of any materials, tools, implements, machinery and buildings on the works or on the property on which these are being or ought to have been executed, and to retain and employ the same in the further execution of the works or any part thereof until the completion of the works without the Consultant being entitled to any compensation for the use and employment thereof or for wear and tear or destruction thereof.
All notices, communications, reference and complaints made by the DFCCIL or the Engineer or the Engineer's Representative or the Consultant inter-se concerning the works shall be in writing or e-mail on registered e-mail IDs i.e. the e-mail id provided for correspondence in the consultancy contract agreement, otherwise e- mail id registered with IREPS and no notice, communication, reference or complaint not in writing or through e-mail, shall be recognized.
