When No Work Is Performed a) Provided that the employee is at work for the full scheduled shift immediately prior to and subsequent to the holiday concerned, he shall receive eight (8) hours pay for clerical employees and eight (8) hours pay for non-clerical employees at the employee's regular rate for the following holidays: New Year's Day Labour Day Good Friday Thanksgiving Day Easter Monday Remembrance Day Victoria Day Christmas Day Canada Day Boxing Day Civic Holiday (see below)
b) For each twelve (12) month period there shall be, in addition to the above named holidays, two (2) "floating holidays", the observance of which is to be determined by mutual agreement between the employee and the Corporation. Employees' written requests for this time off shall be responded to within four (4) working days (excluding statutory holidays). Manpower resources and service requirements in operations permit a minimum of five (5) operators per day to be granted the day off for both floating holidays and lieu days. Therefore, the Operations and Maintenance employees making application first shall receive the day. If more than two (2) employees can be off under this clause subject to article 24.10 b) iii), preference will be given on short notice to the additional employee(s) in seniority order. All requests for Floating Holidays and lieu days, as per Article 25.05, submitted on the same day will be processed at 4:30 p.m. on the day of submission, according to seniority. All Floating Holidays must be taken before June 30th of each year. New employees will be entitled to a floating holiday if they have completed probation prior to June 30th.
c) The requirement to be at work on both the day before and the day after the holiday in order to receive payment will not be waived unless the employee submits a medical certificate justifying the absence. This medical certificate must be submitted within three (3) working days of the employee's return to work following the holiday in order to receive payment. However, in no event will a holiday be paid if the illness commenced more than thirty (30) days prior to the holiday.
d) When Boxing Day falls on a Sunday, it shall be observed on the following Monday.
e) Canada Day will be observed on the day designated by the City. If Canada Day falls on a Saturday or Sunday, it shall be observed on the Friday prior to, or on the Monday following, the weekend on which Canada Day falls, at the discretion of the Corporation.

When No Work Is Performed. Provided that the employee is at work on the required shift immediately prior to and subsequent to the holiday concerned unless the employee is absent on either of the required shifts due to illness or approved leave of absence providing such absence has not exceeded thirty (30) days, such employee shall receive pay at the regular number of hours of work at his regular rate of pay for the following holidays: New Year's Day Thanksgiving Day Good Friday Remembrance Easter Monday One-Half day Christmas Eve Victoria Day Christmas Day Dominion Day Boxing Day Civic Holiday One-Half Day New Year's Eve Labour Day When any of the above listed holidays fall on a Saturday or a Sunday, such holidays shall be observed the previous Friday or the following Monday. In this regard, the Corporation will advise employees two ( 2 ) months advance of the day of observance of the holiday unless the impact of local practice cannot be determined by that time. In such an event, the Corporation will notify the union and post on all bulletin boards, for the information of employees, that local practice cannot be determined and a minimum of one (I) month's advance notice of the observance of the holiday will be given any event. If the Corporation proclaims or declares a holiday on a regular working day, such proclaimed or declared holiday will become a paid holiday in addition to the holidays set out above. For any work performed on the above noted holidays or days upon which they are celebrated, employees shall receive double time for all hours actually worked in addition to their holiday pay as above provided for.
