Use of Cards. The Customer shall, and shall procure that a Cardholder, only use Cards in accordance with the provisions of this Agreement. A Card may not be used in, among others, the following circumstances:

Use of Cards. Company represents and warrants, on behalf of itself and its Employees, that the Cards will only be used for business purposes.
Use of Cards. Only the Card Member whose name is on the Card is permitted to use the Card for Charges, for identification, or for any other reason. You must not use the Card to purchase anything for the purpose of resale unless approved by the Company in writing. You may not return any goods, tickets or services obtained with the Card for a cash refund. However, you may return an item or ticket to a Merchant honouring the Card for credit to the account, if that Merchant permits such returns. You shall not obtain a credit to the account for any reason other than as a refund for goods or services previously purchased with the Card. You must not use the Card if a petition for winding-up of the Company is issued (unless the petition is no longer in force), or if the Company passes a resolution for its liquidation or has a receiver appointed over any of its assets. You must not use the Card if you do not honestly expect that your account will be paid in full on receipt of your monthly statement. You acknowledge and agree that we have the right to refuse authorisation for any Charge without cause or prior notice, and that we shall not be liable to you or anyone else for any loss or damage resulting in such refusal. You may not use the Card for any unlawful purpose, including the purchase of goods or services prohibited by the laws of Singapore or any country where the Card is used or where goods or services are provided. To protect your PIN, telephone codes, online password and any other codes approved by us to be used on your account (called codes), you must ensure that you: • memorise the code; • destroy our communication informing you of the code (if applicable); • do not write the code on the Card; • do not keep a record of the code with or near the Card or account details; • do not tell the code to anyone; • if you select a code, do not choose a code that can easily be associated with you such as your name, date of birth or telephone number; and • take care to prevent anyone else seeing the code when entering it into an Automatic Teller Machine (called ATM) or other electronic device.
Use of Cards. The Card issued to you can be used in India and overseas. You agree and undertake that the American Express Card issued to you, if used overseas shall be utilised strictly in accordance with the relevant exchange control regulations issued and as amended by the Reserve Bank of India (RBI) from time to time. You also agree that in the event you exceed your Foreign Exchange entitlements as per the exchange control guidelines of the RBI, you undertake to bring the same immediately to our notice in writing. Further you also agree and understand that if you are required to get your passport endorsed for any such Charges incurred by you as stipulated by RBI, the onus of getting the passport endorsed shall lie entirely on you. And in the event of any failure to comply with the prevailing exchange control guidelines issued by RBI by you, you shall be liable for any action under the Foreign Exchange Regulation Act, 1973/ Foreign Exchange Management Act, 1999 as amended, and be debarred from the American Express Card facility either at our instance or by the RBI. The Globally Valid Card issued to you is valid for payments in Nepal and Bhutan only in Indian Rupees. Without prejudice to the foregoing, any payment of such Charges by us will be with full recourse to you and you will not be absolved from liability to make such payment and you will indemnify us in respect of any loss, claim or expense incurred by us as a result of your non-compliance with any such regulations. The Card is issued to the person requesting issuance of the same. No other person is permitted to use the Card issued to you for Charges, for identification or for any other reason. If you have let someone else use the Card or you have voluntarily relinquished physical possession of the Card, this will not affect your liability to us for payment of all Charges made with the Card issued to you. You agree to notify us in writing, at once, if the Card is lost, or stolen, or if you suspect it is being used without your permission. You shall also file an FIR with the nearest Police Station from where the loss occurred. Provided that you have acted in good faith, your liability to us arising out of any unauthorised use of the Card prior to such notification shall be limited to Indian `1,000. You agree that you will not resell or return for a cash refund any merchandise, tickets or services obtained with the Card. Use of Cards. 2.1 The client and/or its authorised representative must immediately on receiving the card sign the card on its reverse with a non-erasable ballpoint pen.

Use of Cards. Until the expiry date on the Card, Cardholder, may use a Card to obtain advances from the Bank through the purchase of goods or services or cash advances and for any other purpose which the Bank may permit. The card may not be used after its expiration date. Whenever the card is used to make a purchase or obtain a service, Cardholder shall sign a sales draft or cash advance draft. Should this not be done, Cardholder will nevertheless remain liable for all amounts charged to the account. The currency applicable to statement and account is United States Dollars (USD). The charges for cash withdrawals or pay- ment for transactions, realized in a different currency, shall be converted into USD at the current rate of exchange of the day on which the transaction in question is charged to the Account. The Bank shall not be held liable for purchases, withdraw- als and payments made in any other currency other than USD and the exchange rate used by the corresponding merchant. Settlement will take place through the cardholder’s bank account by converting the USD payment to the corresponding currency of the cardholder’s’ bank account taking into account the daily exchange rate and any applicable government taxes (e.g. License fee).

If requested by Company, loans (“Cash Advances”) may be obtained from any financial institution honoring the Card. Company hereby represents that it will use the Card only for business purposes and that its Employees have agreed to use the Card for business purposes only. Company shall be solely responsible for ensuring its Employees’ proper use of the Card. Issuer will not be responsible for any merchant’s or financial institution’s failure or refusal to honor a Card. Company shall return the Card(s) to Issuer immediately upon Issuer’s request.
Use of Cards. Each Transaction is subject to the terms and conditions of this Agreement and to the terms and conditions of the Cardholder Agreement, if any, in effect at the time of the Transaction. WaFd shall have no obligation or responsibility to the Company or to any Cardholder in the event that any merchant, entity or person refuses to honor a Card or Account. A Card or Account may be used only by the Cardholder to whom it is issued or who is authorized to use it, as the case may be, and may not be transferred to another Cardholder or any other person or entity, and any such attempted transfer shall automatically be void.
