Site Safety and Clean-Up. 5.12.1. The Design-Builder will be required to provide a safe and efficient site, with controlled access. As part of this obligation, the Design-Builder shall be responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the Project, and shall comply with the requirements set forth in Article 16, Section F of the Standard Contract Provisions.

In the event the Design-Builder fails to provide such a plan, the Design-Builder will not be permitted to commence the Construction Phase until such a plan is submitted and in no event shall any resulting delay constitute an Excusable Delay.

The Contractor will be required to: (i) provide a safe and efficient site, with controlled access, including the installation and provision of such safety barricades, enclosures and overhead protection as may reasonably be required by the Department and as may be necessary to ensure a safe workplace or as may be required by OSHA or other applicable law, and to remove such at the end of the Work and leave the site in broom clean condition; (ii) be responsible for the security of its tools, equipment and materials that are stored at the site; (iii) provide wheel washing stations on site so as to prevent the accumulation of dirt and other refuse on the streets surrounding the Project site; (iv) be responsible for site security; and (v) be responsible for the cost of temporary power used during the construction of the Project, including, but not limited to, the cost of installing such temporary wiring as may be required. Section 3.10.1 The Contractor, at no additional cost to the Department, shall provide such safety barricades, enclosures and overhead protection as may reasonably be required by the Department and as may be necessary to safely implement the Work and to remove such at the end of the work and shall leave the site in broom clean condition.

The Contractor shall: (i) keep any City work site areas under the Contract clean from all rubbish and debris as often as required; and (ii) at all times implement, employ and enforce suitable rules and safeguards, and provide any and all guards, fences and protective devices required to ensure the safe completion of the Services and for the safety and health of the general public, any adjacent property, and the workers employed at the work site.

The Construction Manager shall submit to the Department for its review and approval prior to the start of the Construction Phase, the Construction Manager shall prepare a safety plan for the Construction Phase conforming to OSHA 29 CFR 1926. The Construction Manager shall abide by such safety plan during the Construction Phase. In the event the Construction Manager fails to provide such a plan, the Construction Manager will not be permitted to commence the Construction Phase until such a plan is submitted and in no event shall any resulting delay constitute an Excusable Delay.
