Reservation of Capacity. Subject to Section 3.1 with respect to the manufacture and delivery of the Minimum Launch Stock, Encap will ensure that it will be in a position to manufacture and deliver all of the remainder of the Launch Stock by [***]. The Launch Stock (including the Minimum Launch Stock, as applicable) will be released on an on-going basis for secondary packaging in accordance with the delivery dates specified in the applicable Purchase Order. Additionally, by [***], Encap will ensure that it will be in a position to manufacture and supply at least [***] [***] units of Product in a twelve (12) month period ([***] units of Product monthly) based on the rolling Forecast submitted pursuant to Section 3.2 above. Should Customer determine that it requires greater than [***] units of Product in any twelve (12) month period, then the Parties shall negotiate in good faith costs and resources associated with such increased production demand.
Reservation of Capacity. Transporter reserves the right, but shall not be obligated, to reserve for expansion projects capacity which is or will become available. For purposes of this Section 2.1(b)(3), Transporter may reserve capacity currently posted on Transporter’s Interactive Website as unsubscribed, available capacity (“Unsubscribed Capacity). Any capacity reserved by Transporter must first be posted on its Interactive Website as reserved. The reservation posting shall be posted for five (5) business days and shall include, but not be limited to, the following information: (1) a description of the expansion project for which the capacity is being reserved; (2) the quantity of capacity being reserved; (3) the location of the reserved capacity on the pipeline system; and (4) the estimated in-service date of the expansion project. The reservation posting shall also include a non-binding solicitation for turnback capacity to serve the expansion project, provided that Transporter shall post the non-binding solicitation for turnback capacity no later than ninety (90) days after the close of the expansion project open season. Transporter shall make reasonable efforts to update the reservation posting up to the in-service date of the expansion project to reflect any material changes in the scope of the expansion project. Transporter is only permitted to reserve capacity up to twelve (12) months prior to the filing of a certificate application, and thereafter until the project goes into service, the application is withdrawn, or the application is denied. Transporter will not, absent Commission approval, accept advance payments to reserve capacity under this Section 2.1(b)(3). Any capacity reserved under this Section 2.1(b)(3) shall be made available for transportation service pursuant to these General Terms and Conditions, on a limited-term basis up to the in-service date of the expansion project(s). For such limited-term agreements, Transporter reserves the right to limit, in accordance with Section 2.1(b)(8) any extension rights provided in the service agreement and pursuant to Section 16 commensurate with the proposed in-service date of the expansion project. Transporter will indicate in any open season posting of the capacity any limitations on extension rights that will apply to such limited term transportation service.
Reservation of Capacity. Pursuant to Section 5(A) of the Development Agreement, CITY is obligated to DEVELOPER to provide priority placement in the Utility Capacity Queue, and CITY hereby confirms that such priority has been previously established for all Phases of the Project and the Project is exempt from the requirements of City Code for a Utility Capacity Queue Agreement. Prior to the issuance of a site development permit for any phase of the Project that includes residential units, an agreement for reservation of capacity is required as provided in City Code.

Reservation of Capacity. Encap will ensure that it will be in a position to manufacture and supply [***] units of Product per month and an aggregate maximum of [***] units of Product in a twelve (12) month period based on the rolling Forecast submitted pursuant to Section 3.2 above. Notwithstanding the foregoing, in case the quantities according to the provided Forecast amount to a quantity lower than the aforementioned, a lower capacity for the twelve (12) months period will be held. Should the Customer determine that it requires a quantity greater than [***] units of Product in any twelve (12) months, then the Parties shall negotiate in good faith any activities, costs and resources associated with such increased production demand.”
Reservation of Capacity. Notwithstanding anything contained herein to the contrary, if at the time notice is given by a holder of Special Company Securities pursuant to the first sentence of Section 3.6 hereof, sufficient throughput capacity at the Facility is not available (because of contractual obligations, including those arising under this Article 3, or casualties, equipment failures, force majeure or events beyond the reasonable control of the Company) to accommodate in full the use requested thereby for all or any part of the period covered by such notice, the Company shall make available to such holder any available throughput capacity of the Facility during the period covered by such notice. Notwithstanding anything contained herein to the contrary, if at the time notices are given by two or more holders of Special Company Securities pursuant to the first sentence of Section 3.6 hereof, sufficient throughput capacity at the Facility is not available (due to such causes) to accommodate in full the uses requested thereby for all or any part of the periods covered by such notices and if such notices are given or deemed to have been given at the same time, the Company shall allocate any available throughput capacity among such holders on a monthly basis so as to be able to satisfy the same percentage of monthly use set forth in each such notice during the periods covered by such notices. In any event where available through-put capacity of the Facility during the period covered by the notice given by a holder under the first sentence of Section 3.6 will not satisfy the quantity set forth in such notice, the Company shall have no obligation to reserve or make available to such holder any throughput capacity beyond the period covered by such notice unless such holder shall have given a new notice under the first sentence of Section 3.6. For the purposes hereof, such notices shall be deemed to have been given at the same time if they are given within forty (40) days of each other. In all other cases, the throughput capacity of the Facility shall be made available under this Article 3 on a "first come, first served" basis.
