Outside Activities (Moonlighting. Resident acknowledges that Resident owes his/her primary duty and responsibility to the Residency Program. Professional and patient care activities that are external to the educational program are called moonlighting. No Resident can be required to engage in moonlighting activities. Resident recognizes that certain Residency Programs may prohibit or otherwise restrict moonlighting by residents, at the sole discretion of the Residency Program. Resident acknowledges that permission of the Program Director is required prior to any moonlighting. Resident acknowledges that all moonlighting activities must be in compliance with Program and ACGME duty hour rules and regulations. Resident, while engaged in moonlighting, is not covered by the professional liability insurance supplied by UCMC under the GME Contract. Resident agrees to comply with the written moonlighting policies of UC Health, UCMC and College. The moonlighting policy is available on the GME website or through the Office of Graduate Medical Education. Resident understands that UCMC may immediately terminate the GME Contract if Resident fails to comply with any applicable moonlighting policies of ACGME, UC Health, UCMC and College.

Outside Activities (Moonlighting. Professional activity outside the scope of the House Officer Program, which includes volunteer work or service in a clinical setting, or employment that is not required by the House Officer Program (moonlighting) shall not interfere in any way with the responsibilities, duties and assignments of the House Officer Program. House Officers must not be required to moonlight. It is within the sole discretion of each Department Head and/or Program Director to determine whether outside activities interfere with the responsibilities, duties and assignments of the House Officer Program. Before engaging in activity outside the scope of the House Officer Program, House Officers must receive the written approval of the Department Head and/or Program Director of the nature, duration and location of the outside activity. Foreign Medical Graduates sponsored for clinical training as a J-1 by ECFMG are not allowed to moonlight or perform activities outside the clinical training program. All moonlighting activities must be counted in the 80 hours maximum work hour limit. House Officers must track these moonlighting hours into their duty hours and must not schedule moonlighting so as to exceed the 80 hour week. Failure of residents to track hours or to allow moonlighting to cause work in excess of the 80 hours will result in disciplinary action. (Revised June 2007, Feb 2011)

Outside Activities (Moonlighting. The Resident understands and agrees that the Resident shall not engage in any work outside the Hospital unless the Resident is appropriately licensed and has obtained the prior written consent of the Hospital's Residency Program Director. Notwithstanding the foregoing, the Resident acknowledges that he or she is strictly prohibited from moonlighting so long as classified as a "Post Graduate Year" ("PGY") 2 resident in the Residency Program. The Resident further understands and agrees that any such permitted outside activities shall nevertheless not interfere with the Resident's ability to achieve the educational requirements of the Residency Program and such work shall not replace any educational criteria of the Residency Program. The Resident acknowledges that while engaging in any outside activities (whether or not approved in accordance with this Agreement), the Resident is not acting as an employee or agent of the Hospital and accordingly is not covered by the Hospital's professional or general liability policies or by the Hospital's workers' compensation insurance. The Resident agrees to obtain professional liability insurance coverage for all outside activities at the Resident's own cost. The Resident further agrees that the Resident's total work hours within the scope of this Agreement and for any outside activity shall not exceed the duty hour policy described in any Applicable Manuals.
Outside Activities (Moonlighting. The Resident shall not engage in any activity that could interfere with the Resident’s obligations to the University, College of Medicine, or Hospital, or the effectiveness of the educational program that is being pursued. Outside employment is not permitted unless prior written approval from the respective Program Director is obtained. Permission to engage in outside employment or similar off-duty activities may be withdrawn if in the opinion of the Program Director such employment or similar activity is interfering with the Resident’s assigned duties or obligations.

Resident may not practice medicine outside the scope of this Agreement without the prior written consent of the Health Center and Program Director, exercised in their sole discretion. Resident acknowledges that such outside services must be performed on Resident’s own time and shall not interfere with Resident's rendering of services hereunder. Resident further acknowledges and agrees that Resident shall procure, at Resident's sole cost and expense, all malpractice/professional liability insurance necessary to protect and insure Resident when Resident practices medicine outside the scope of this Agreement and that the Health Center's malpractice/professional liability insurance policies and/or programs of self-insurance do not cover Resident when Resident practices medicine outside the scope of this Agreement. Resident shall provide the Health Center with Certificates of Insurance verifying such coverage prior to practicing medicine outside the scope of this Agreement. In the event that such outside services interferes with Resident's rendering of services hereunder, as determined by the Resident’s Program Director in his/her sole discretion, the Resident will be required to curtail or discontinue such outside services. Resident acknowledges that the institutional permit issued for medical practice during approved program rotations does not apply to outside services provided by Resident.

Resident further agrees that Resident’s total work hours within the scope of this Agreement and for any outside activity shall not exceed the duty hour policy described in the Sponsor’s House Staff Manual or Residency Program Manual.

Resident further agrees that Resident’s total work hours within the scope of this Agreement and for any outside activity shall not exceed the Clinical Experience and Education Work Hours described in the Sponsor’s House Staff Manual or Residency Program Manual.
Outside Activities (Moonlighting. The Resident shall not engage in any activity that could interfere with the Resident’s obligations to the University or the effectiveness of the educational program that is being pursued. Outside employment is not permitted unless prior written approval from the respective Program Director is obtained in accordance with GME Policy #36. Permission to engage in outside employment or similar off-duty activities may be withdrawn if in the opinion of the Program Director such employment or similar activity is interfering with the Resident’s assigned duties or obligations. In the event Resident engages in outside activity or the Program Director is of the opinion such activities are taking place, Resident shall execute such documents as may be requested by the Program Director in order to verify or perform a financial audit of such activity.
