RECOGNITION AND UNIT DEFINITION. 34 35 Pursuant to certification notice from the State of California Public Employment Relations 36 Board (PERB) (Los Angeles Regional Office) dated May 30, 1986, the District recognizes 37 Associated Chino Teachers/California Teachers Association/National Education 38 Association as the exclusive representative for the unit which is described in Appendix A 39 and incorporated herein by reference. 40 41 1.4.1 The parties recognize that the duties and work described in this Agreement shall be 42 performed only by bargaining unit members as set forth in Appendix A, unless there are 43 no unit members who are qualified and/or interested in performing the work, as determined 44 by site administrator and/or the Division of Human Resources. 45 1 1.4.2 With regard to extra duty pay assignments, positions held by non-bargaining unit members 2 shall be annually advertised District-wide by the District before May 1st. Unit members 3 seeking coaching or advisory positions shall be given first consideration before non- 5 advertised only when a vacancy occurs, and this precludes the need for an annual search 6 for these positions. Prior to contracting out bargaining unit work, the District shall 7 determine that there are no bargaining unit members who are qualified and/or interested in 10 1.4.3 Any open teaching position held by a substitute teacher, other than a position previously 11 held by a unit member who is currently on a leave of absence for 120 days or less, shall be 12 deemed a vacant position after twenty (20) workdays unless otherwise extended by mutual 13 agreement. Vacant positions shall be filled according to the provisions of Article 15 of the 14 Agreement.

RECOGNITION AND UNIT DEFINITION. The Board recognizes the Association as the sole and exclusive bargaining representative for collective bargaining purposes for all full-time faculty in the appropriate bargaining unit. The appropriate bargaining unit shall consist of all full-time teaching faculty and head coaches with teaching load, excluding the Administration, e.g., President and Vice Presidents.

The Employer recognizes the Union as the exclusive representative for all NAF Employees employed by the Employer, excluding all professional employees, management officials, employees engaged in intelligence, counter intelligence, investigative or security work which directly affects national security, employees primarily engaged in investigation or audit functions relating to work which directly affects the internal security of the agency, employees engaged in Federal personnel work in other than a purely clerical capacity and supervisors. Employees included in the bargaining unit are all non- professional and professional Wage Grade (WG) and General Schedule (GS) Department of the Army civilian employees paid from Appropriated Funds, serviced by the Fort Leavenworth Civilian Personnel Advisory Center (▇▇▇▇), and whose duty station is Fort Leavenworth, under the jurisdiction of the: CAC and Fort Leavenworth, TRAC at FLVN, IMCOM, MICC, MEDCOM, ACC, NEC, USAFMSA, and LRC at Fort Leavenworth, Kansas. Section 1.2. Employees excluded from the bargaining unit are all supervisors, management officials, managerial trainees, confidential employees, employees on time-limited appointments, employees engaged in Federal personnel work in other than a purely clerical capacity, and/or other employees described in 5 U.S.C. 7112(b).

RECOGNITION AND UNIT DEFINITION. The Board recognizes the Association as the exclusive collective bargaining agent for all professional employees who are certified by the New York State Department of Education and who are employed on a regular employee basis of at least two full school days per week, or its equivalent, by the District in one of the following job classifications: 1. Elementary, Secondary, and all other Certified Teachers 2. Permanent Substitute School Teachers (i.e., those hired upon initial employment for a specific full-time substitute position for a period of three months or more.) 3. School Psychologists 4. School Counselors 5. Speech Pathologist, Speech and Hearing/Language Teacher 6. Social Worker

RECOGNITION AND UNIT DEFINITION. ▇▇▇▇▇ agrees that the Association is the sole and exclusive bargaining agent for all school monitors (bus attendants), teacher aides, custodial workers, receiving clerks, couriers, data entry operators, clerks, printer’s assistants, typists, account clerks, custodial worker/property guards, stenographers, senior typists, assistant printing machine operators, computer services assistants, audio visual repair workers, maintenance workers, senior account clerks, senior stenographers, mechanics, bus drivers, personnel assistants, maintenance mechanics, administrative aides, printers, principal account clerks, LAN technicians, school security officers, AV specialists and technology training specialists regularly working 20 or more hours, and terms and conditions of employment and in settlement of grievances and all other lawful purposes under the laws of the State of New York. Titles agreed to be eliminated from this Article 1.1, shall be reinstated if any such title or work performed by such title is revived by the BOCES.

RECOGNITION AND UNIT DEFINITION. ▇▇▇▇▇ agrees that the Association is the sole and exclusive bargaining agent for all Teaching Assistants regularly working half time or more hours, and terms and conditions of employment in settlement of grievances and all other lawful purposes under the laws of the State of New York.

The Employer recognizes the Union as the exclusive bargaining agent under Title VII, Civil Service Reform Act, for all employees described in Section 2 of this Article. Section 2. The unit to which this Agreement is applicable is Non-Appropriated employees at Fort Leavenworth, Kansas, excluding all Post Exchange employees, management officials, employees engaged in Federal personnel work in other than a purely clerical capacity, professional personnel and supervisors as defined 1n Title VII, Civil Service Reform Act.
