Any content you access through the Internet access Services is provided by independent third-party content providers over which Xxxxxxx does not exercise control. Astound does not preview, exercise editorial control over, or endorse any opinions or information accessed through the Services. You expressly understand and agree that it is possible data or files you send or receive over the Internet will be monitored by third-parties and/or subject to unauthorized access by third-parties. Third-parties may gain access to your data, including confidential information. Data or files transmitted over the Internet may contain computer viruses, ransomeware, or other harmful components. Astound has no responsibility and assumes no liability for any such acts or occurrences. You expressly assume the risks inherent in connecting your internal network and your Customer Equipment to the Internet and in accessing and using the Internet through the Services.
Acceptance of Risk. As a condition of entering into the Agreement and participating in a Tour, Traveler represents, warrants, and agrees that is has received, reviewed, and executed the “Release and Assumption of Risk” document provided by Infinity or FA to Traveler.

I understand that EYC shall have no responsibility to pay for medical treatment and related costs if Child is injured. Knowing the risks described above, I agree, personally and on behalf of Child, to assume all the risks and responsibilities surrounding Child’s participation in Sailing. Indemnification and Hold Harmless: I agree to indemnify and hold harmless EYC, its members, Board of Directors, agents, servants, employees, and volunteers (collectively “Releasees”) from and against all claims, demands, and judgements, including attorney fees, made or recovered against Releasees including, but not limited to, damages to real or tangible personal property or for bodily injury or death to any person, arising out of, or in any way related to Child’s participation in Sailing (collectively “Claims”). I will notify EYC in writing of any Claims and shall cooperate with EYC in a reasonable manner to facilitate defense of such Claims. Permission to Publish: I give EYC permission to publish photos, videos, and recordings taken of Child or I during activities related to Sailing. I understand that neither Child nor I will be paid any royalty or other compensation and I give up any right Child or I may have to payment if a photo, video, or recording is published. Complete Contract: This Agreement constitutes the entire agreement between the EYC, Child, and me with respect to the subject matter hereto. The Resident acknowledges and accepts the risks associated with the residential nature of independent living in The Resident’s own Suite, and at Derby Manor (Building & Grounds or any property associated legally or otherwise with Derby Manor) consistent with The Resident’s choice of lifestyle.

You acknowledge that you may be travelling to countries or regions where political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. It is your responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. Pet Parent acknowledges that when dogs play in groups that nicks, bites or scratches may occur, and Company may or may not notify Pet Parent immediately if the pet sustains any nicks, bites or scratches. Pet Parent further acknowledges that animals are unpredictable and that there is a possibility of injury or death to the pet or to another animal or person. Therefore, as consideration of the services rendered by Company, Pet Parent (A) hereby waives and releases Company, and its invitees, sponsors, members, managers, advertisers, owners, officers, directors, employees, volunteers, invitees, agents, lessors, and any parties owning, controlling or having any interest in the property where the Company facility is located, and all other representatives or agents of Company (collectively, “Company Parties”) from any and all claims, actions, damages or liability for injury, sickness or illness suffered by his or her pet while in the care of Company or otherwise relating to the care, control, health and/or safety of the pet arising from pick up, transport, drop off and/or stay at the Company facilities, except to the extent such illness or injury is the result of Company’s gross negligence or intentional misconduct, and (B) agrees not to initiate any legal proceedings against Company or any Company Parties with respect to such released claims. “Sickness and illness” shall be defined to include any illness, including, without limitation, bordetella (kennel cough) or any other form of contagious illness.
Acceptance of Risk. I understand there is a risk of injury from using Home Medical Equipment, including the potential for bodily injury, death, and property damage. I understand that accidents can occur while using Home Medical Equipment as a result of negligence or otherwise. I KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERS, and I assume full responsibility using any Home Medical Equipment provided by FMC. Covenant Not to Xxx: I, on behalf of myself, my family, heirs, assigns, personal representatives, and administrators hereby release, waive, forever discharge, and agree to NOT sue or proceed in any manner against FMC, it's officers, directors, officials, members, agents, and/or employees, from and for any and all liabilities, claims, demands, and/or losses related to any and all injuries, disabilities, deaths, or damage to any person or property, as a result of using any Home Medical Equipment provided by FMC.
