Warranty of Conformance. The Supplier warrants that all Products at the time of delivery on Delivery Date are, and at all times in the future will be, free from defects in design, materials or workmanship and will be manufactured to fully comply with the requirements set out in clause 9.1 (including, without limitation, the Specifications). This warranty is unaffected by a Purchaser’s: (a) acceptance of delivery of a Product, (b) payment for a Product or an associated delivery; (c) removal of a Product from a Storage Area or (d) right of inspection of a Product. This clause 18.1 does not apply to defects which apply to or affect only a single item or small number of items (“Isolated Problem”). In such a case, Supplier’s obligation is to replace or repair the affected item at the relevant Purchaser’s option. That obligation continues for twenty four (24) months or such other period as may be specified in Item 12 of the Contract Note, following the transfer to the relevant Purchaser of title in the affected item. Without limiting what is meant by an Isolated Problem, any problem, issue or defect which affects a batch of Products such that it fails to meet the quality standards set out in Schedule 4 of the relevant Contract Note (including where the problem manifests itself over a period of time) is not an Isolated Problem.
Warranty of Conformance. By clicking the "Accept" button below, the Candidate hereby warrants and represents that he/she meets the applicable Conformance Requirements at the time of certification and will continue to meet the Conformance Requirements throughout the time in which they are certified, in accordance with the Certification Policy. If the Candidate fails to ensure continued compliance with the applicable Conformance Requirements, the Certification Authority may revoke the certification for the Candidate. For the avoidance of doubt, any demonstrable shortfall with respect to the applicable Conformance Requirements is grounds for withdrawal of certification, whether or not that shortfall is apparent from the supporting evidence supplied and the certification process itself.
Warranty of Conformance. 3.3.1 By signing this Agreement below, the Organization hereby warrants and represents that the Candidate Certification Program identified in the Registration Form, as entered in the web-based certification system, meets the Accreditation Requirements at the time of Accreditation and will continue to meet the Accreditation Requirements throughout the duration of Accreditation, in accordance with the Accreditation Policy.
Warranty of Conformance. At the time of delivery of the Gold ----------------------- Software for the applicable phase and for a period of [*] after the first shipment of the Licensed Software for the applicable phase, the Licensed Software included in that delivery will conform in all material respects to, and substantially comply with, the specifications in the applicable SOW and Schedule 1.2 of Exhibit A. Compaq's exclusive remedy and Altiris' entire liability for any breach of the foregoing warranty is that Altiris will use reasonable efforts to repair or replace the Licensed Software so that it does materially conform to, and substantially comply with, such specifications; provided, that, if Altiris is unable to make such repair or replacement and determines that it is commercially unreasonable to have that Licensed Software comply with and conform to the above warranty, then Altiris shall so notify Compaq and Compaq may either (a) accept that Licensed Software without requiring further modifications for conformance or (b) elect to terminate the license with respect to that particular Licensed Software. Such termination is otherwise subject to the terms and conditions of Section 11.5, except that (x) if the Licensed Software is for Quick Silver [*], then Compaq will be entitled to receive (for internal use, resale or distribution), without cost, [*] licenses (measured by number of Intel Compatible Servers) of version 5.1 of Altiris eXpress under and otherwise subject to all of the terms of the ABG Agreement, but for deployment or redeployment of Compaq Products, or (y) if the Licensed Software is for Quick Silver [*] or Quick Silver [*], Compaq will be entitled to receive (for internal use, resale or distribution), without cost, 10,000 licenses (measured by number of Intel Compatible Servers) of the most recent version of Quick Silver [*]. The foregoing remedies and limitations do not affect either party's rights or obligations pursuant to Section 6.

By accepting the terms of this Agreement, the Candidate hereby warrants and represents that he/she meets the applicable Conformance Requirements at the time of application for a Milestone or for Certification and will continue to meet the Conformance Requirements throughout the time in which they hold a Milestone Badge or Certification, in accordance with the Certification Policy. If the Candidate fails to ensure continued compliance with the applicable Conformance Requirements, the Certification Authority may revoke a Candidate’s Milestone Badge or Certification. For the avoidance of doubt, any demonstrable shortfall with respect to the applicable Conformance Requirements is grounds for withdrawal of the Milestone Badge or Certification, whether or not that shortfall is apparent from the supporting evidence supplied and the review or certification process itself.

By signing in Clause 10 “Execution” below, the Supplier hereby warrants and represents that the product identified in the Registration Form, as entered in the certification system, meets the Conformance Requirements at the time of certification and will continue to meet the Conformance Requirements throughout the time during which the product is certified, in accordance with the Certification Policy. If the Supplier fails to ensure continued compliance with the Conformance Requirements, the Certification Authority may revoke the certification for the product. For the avoidance of doubt, any demonstrable shortfall with respect to the Conformance Requirements is grounds for withdrawal of certification, whether or not that shortfall is apparent from the supporting evidence supplied and the certification process itself.

Warranty of Conformance. 3.4.1 By signing this Agreement below, the Organization hereby warrants and represents that the Candidate Training Course identified in the Registration Form, meets the Accreditation Requirements at the time of Accreditation and, after achieving Accreditation, the ATC will continue to meet the Accreditation Requirements throughout the duration of Accreditation, in accordance with the Accreditation Policy.
