Variation of Charges. (a) Subject to clause 5.6(b), ARTC will immediately pass on to the Access Holder any net effect of any imposition of new taxes or charges, increases or decreases in taxes or charges (other than income tax) which is a tax, royalty, rate, duty, levy or impost of general application imposed on ARTC by any government or regulatory authority and which is directly attributable to the provision by ARTC to the Access Holder of access to the Network.

Additionally, where the Service is being terminated by a Third Party Supplier at the Customer Premises, the Charges set forth in the Order Form for such Service assumes that such Service will be terminated at a pre- established Service Demarcation Point or minimum point of entry (MPOE) in the building within which the Customer Premises is located, as determined by the Third Party Supplier. Notwithstanding the foregoing, Optify Mediaforce may pass through to Customer additional Charges not otherwise set forth in the Order Form for such Service where the Third Party Supplier determines that it is necessary to extend the Service Demarcation Point or MPOE through the provision of additional infrastructure, cabling, electronics or other materials necessary to reach the Customer Premises.
