The "Sunday and Holidays" clause defines how contractual obligations or deadlines are affected when they fall on a Sunday or a recognized public holiday. Sunday and Holidays. (a) The Company will endeavour not to schedule or require work on holidays (as listed in this Agreement) or Sundays, and an employee shall have the option of declining such work. When such work is performed by an employee on a holiday, the employee shall be paid at the rate of two (2) times his regular rate of pay, in addition to holiday pay. When such work is performed by an employee on a Sunday, the employee shall be paid at the rate of two (2) times his regular rate of pay. Premiums shall not be pyramided.
(b) Where scheduled shift work starts on a Friday night and finishes on a Saturday morning, or starts on a Sunday night and finishes on a Monday morning, such work shall not be paid at overtime rates. Where a scheduled shift starts on the night before a designated holiday and finishes on the holiday, such hours worked on the holiday will not be paid at overtime rates. Where a shift begins on a Saturday night and finishes on a Sunday morning, the shift shall be paid at the Saturday overtime rate.
