Return Rights. The President and Vice-President will have the right to return to the same position or in another position in the same job classification and the same geographic area as determined by the Employer, provided such reemployment is not in conflict with other articles in this Agreement. The employee and the Employer may enter into a written agreement regarding return rights at the commencement of the leave. The period of leave will not impact the employee’s seniority date.
Return Rights. Upon assignment to a new or vacant position, a NAV CANADA employee shall be granted a familiarization period of up to forty-five (45) days worked during which the employee or NAV CANADA may determine that the employee be returned to his or her former position subject to the following:

The employer will assess any training needs required to update the returning employee to changes that have occurred in the position, and will provide such training to the returning employee. Any layoff as a result of the return will be processed in accordance with Article 35,

The employee and the College may enter into a written agreement regarding return rights prior to the commencement of the leave.

Return Rights a) For a period not to exceed ninety (90) days following the date of availability, the University will offer the Employee the opportunity to be placed in vacant positions for which such Employee is qualified. Failure to accept two (2) offers of employment shall satisfy the Employer's return to work obligation.
Return Rights a. Return to a comparable position: Based upon their seniority and qualifications, an employee who has been reduced in hours, work days, or SP Salary Schedule level shall have the right to return to a position comparable to the one held during the previous school year and shall request the right to return in writing to Employment Services each year. If the above does not occur within one year, the right to return to a comparable position shall be extended for a second year.
Return Rights. Dealer will have the right to return for full credit or refund of Dealer's cost any Products (a) against which an allegation is made that the use of such Products infringes on any patent, trademark, trade secret, copyright, right of privacy or publicity, or any other tangible or intangible proprietary or intellectual property right; (b) that are not manufactured, packaged, or labeled in accordance with industry standards and/or all applicable laws, ordinances, rules, and regulations; (c) that are shipped in error or in non-conformance with Dealer's purchase order; (d) that have caused injury to person or property; and (e) that are damaged or Defective. Returned Products will be shipped FOB Origin, Freight Collect from Dealer's product return center, distribution center or stores, as the case may be.
Return Rights. Upon return from a leave taken for a reason listed under Subsection A(1)-(4) above, the employee will be returned to his/her former position or to a position equivalent in pay, benefits, and other terms and conditions of employment. In all other circumstances, the employee is not guaranteed that he/she will be restored to his/her former position or to an equivalent position. The decision will be at the discretion of the Employer.
