Same Position. If an employee terminates his or her employment and is rehired 39 by the District into the same position within one year from the date of termination 40 and the position is on the Market Rate Salary Schedule, the employee will be paid 41 his or her base rate (hourly rate) at the time of termination or the Market Rate, 42 whichever is greater.

Same Position. The parties hereby agree that the intent of this Agreement is to provide the same economic terms and conditions to both the Company and AOL as those set forth in the Letter Agreement dated September 16, 1997 between AOL and the Company (the "Letter Agreement") and to otherwise place AOL in the same position AOL would have been in had AOL purchased the Shares and the Warrant Certificate as contemplated by the Letter Agreement prior to giving effect to any amendment of such Letter Agreement. In connection therewith, the Company shall take all actions necessary in the reasonable judgment of AOL to provide AOL with all rights, privileges and benefits as it would have had had AOL purchased the Shares as contemplated by the Letter Agreement (prior to giving effect to any amendment thereto). The Company agrees to modify this Agreement or any other agreement contemplated hereby or to enter into any additional agreements as AOL shall reasonably determine necessary to effectuate the foregoing.
Same Position. If an employee occupying the same position is moved to a higher pay range within a broad-banded job classification and fails to satisfactorily complete his or her probationary period as defined in A. above, the employee shall be returned to the lower pay range within that classification.
Same Position. A contracted bus driver who is injured on the job will be returned to his/her same position and route if he/she is medically certified to return to full-time, unrestricted service within six months of such injury. If a contracted bus driver is not medically certified to return to full-time, unrestricted service within six months of a job-related injury, he/she will be entitled to the next available route following his/her unrestricted medical release up to one year after such injury. If a bus driver is not able to return to work after a job-related injury within one year of such injury, his/her entitlement to any bus route is void.

  • Term Position A position occupied by a full-time or part-time nurse for a specified period of time, up to a maximum of sixty (60) weeks, where patient/client/resident census or workload necessitates a temporary increase in staffing, if mutually agreed, to replace a nurse(s) who is/are on vacation or leave of absence, or to carry out a special short term project or where the Employer has provided notice of permanent deletion of position(s) under the Memorandum of Understanding regarding Employment Security, or as otherwise mutually agreed between the Union and the Employer. If the Employer determines there is a term position to be filled by a nurse, the term position shall be posted in accordance with Article 30. This shall not preclude the Employer from utilizing part-time nurses and/or casual nurses to work available shifts as specified in Articles 34 and 35 when the Employer decides that a term position is not required. The Employer shall provide written confirmation of the start and expiry dates of the term position prior to the nurse's commencement in the position. This period may be extended if the Employer so requests and the Union agrees.
