Provision of Access. Subject to the terms of this Agreement, Flock hereby grants to Agency a non-exclusive, non-transferable right to access the features and functions of the Services via the Web Interface during the Service Term (as defined in Section 6.1 below), solely for the Authorized End Users. The Footage will be available for Agency ’s designated administrator, listed on the order form, and any Authorized End Users to access via the Web Interface for thirty (30) days. Authorized End Users will be required to sign up for an account and select a password and username (“User ID”). Flock will also provide Agency with the Documentation to be used in accessing and using the Services. Agency shall be responsible for all acts and omissions of Authorized End Users, and any act or omission by an Authorized End User which, if undertaken by Agency, would constitute a breach of this Agreement, shall be deemed a breach of this Agreement by Agency. Agency shall undertake reasonable efforts to make all Authorized End Users aware of the provisions of this Agreement as applicable to such Authorized End User’s use of the Services, and shall cause Authorized End Users to comply with such provisions. Flock may use the services of one or more third parties to deliver any part of the Services, including without limitation using a third party to host the Web Interface which makes the Services available to Agency and Authorized End Users. Warranties provided by said third party service providers are the agency’s sole and exclusive remedy and flock’s sole and exclusive liability with regard to such third-party services, including without limitation hosting the web interface. Agency agrees to comply with any acceptable use policies and other terms of any third-party service provider that are provided or otherwise made available to Agency from time to time.

Agency shall be responsible for all acts and omissions of Authorized End Users, and any act or omission by an Authorized End User which, if undertaken by Agency, would constitute a breach of this Agreement, shall be deemed a breach of this Agreement by Agency. Agency shall undertake reasonable efforts to make all Authorized End Users aware of the provisions of this Agreement as applicable to such Authorized End User’s use of the Flock Services and shall cause Authorized End Users to comply with such provisions. Flock may use the services of one or more third parties to deliver any part of the Flock Services, including without limitation using a third party to host the Web Interface which make the Flock Services available to Agency and Authorized End Users. Flock will pass- through any warranties that Flock receives from its then current third-party service provider to the extent that such warranties can be provided to Agency. SUCH WARRANTIES, AS PROVIDED AS HONORED BY SUCH THIRD PARTIES, ARE THE CUSTOMER’S SOLE AND EXCLUSIVE REMEDY AND FLOCK’S SOLE AND EXCLUSIVE LIABILITY WITH REGARD TO SUCH THIRD-PARTY SERVICES, INCLUDING WITHOUT LIMITATION HOSTING THE WEB INTERFACE. Agency agrees to comply with any acceptable use policies and other terms of any third-party service provider that are provided or otherwise made available to Agency from time to time.

Customer shall undertake reasonable efforts to make all Authorized End Users aware of the provisions of this Agreement as applicable to such Authorized End User’s use of the Flock Services and shall cause Authorized End Users to comply with such provisions. Flock may use the services of one or more third parties to deliver any part of the Flock Services, including without limitation using a third party to host the Web Interface which make the Flock Services available to Customer and Authorized End Users. Customer agrees to comply with any acceptable use policies and other terms of any third-party service provider that are provided or otherwise made available to Customer from time to time.
Provision of Access. Subject to the terms and conditions of the Agreement, DebtBook grants Customer and Customer’s Authorized Users a non-exclusive, non-transferable (except as permitted by these Terms) right to access and use the Application Services during the Term, solely for Customer’s internal use and for the Authorized Users’ use in accordance with the Agreement. DebtBook will provide to Customer the necessary passwords and network links or connections to allow Customer to access the Application Services.
Provision of Access. 2.1 The Depot Facility Owner shall provide the Beneficiary with Access up to the Minimum Level of Services as specified in paragraph 1 of Appendix 1.

Subject to and conditioned on your payment of Fees and compliance with all other terms and conditions of this Agreement, Provider hereby grants you a revocable, non- exclusive, non-transferable, non-sublicensable, limited right to access and use the Cloud Services during the Term solely for your internal business operations by Authorized Users in accordance with the terms and conditions herein. Provider shall provide you the necessary passwords and access credentials to allow you to access the Cloud Services.
Provision of Access. Subject to the terms and conditions contained in this Agreement, CrossLead hereby grants to Company and its Authorized Users a non-exclusive, non-transferable right to access the features and functions of the applicable CrossLead Module set forth in the applicable Order Form during the Term set forth on the Order Form for the number of Authorized Users set forth on the Order Form up to the Service Limits. Unless otherwise set forth in an Order Form, each Authorized User will have access to a maximum of three (3) gigabytes (“GB”). In the event an Authorized User exceeds the maximum GB allowed under this Agreement or an Order Form if different, the Company will have seven (7) days to reduce the amount of storage to the applicable limits, or Company will be charged $.05 per GB per month in excess of the applicable limits. On or as soon as reasonably practicable after the Effective Date, CrossLead shall provide to Company the necessary passwords, security protocols and policies and network links or connections and Access Protocols to allow Company and its Authorized Users to access the CrossLead Module. Company and any Authorized User may only use the CrossLead Module in accordance with the Access Protocols.
Provision of Access. You understand and agree that your use and enjoyment of the Product is subject to and conditioned on Customer being in good standing with Reseller and Synacor, as specified by all terms and conditions of the Order Form and these EU Terms. The Product is offered as a revocable, non-exclusive, non-transferable, non-sublicensable, subscription-based Hosted Service that is accessible for production use only during the Term and by End Users for internal business purposes only.

Provision of Access. Throughout the term of this Agreement, PSINet shall provide Subscribers with Access at the levels then provided and supported by PSINet. A recent estimated listing of Network POPs can be retrieved through access to PSINet's world-wide web site at 'xxxx://xxx.xxx.xxx'. PSINet reserves the right to install new POPs and/or to close existing POPs as it, in its sole discretion, deems appropriate. In the event PSINet deems it necessary to close an existing POP, PSINet shall provide Retailer with sixty (60) days written notice thereof. Retailer may order such Access on behalf of its present or future Subscribers and there shall be no limit on the number of Subscribers who may use the Network; provided, however, that PSINet may refuse service to Retailer because there is insufficient capacity on the Network or in the POP to provide the Access amount requested. In the event PSINet determines there to be such lack of capacity, then the provisions of Section 4.10 herein do not apply to the effected POP during any month for which such insufficient capacity occurs.
