Protection of Your Data. We will maintain administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of Your Data, as described in the Documentation. Those safeguards will include, but will not be limited to, measures for preventing access, use, modification or disclosure of Your Data by Our personnel except (a) to provide the Purchased Services and prevent or address service or technical problems, (b) as compelled by law in accordance with Section 8.3 (Compelled Disclosure) below, or (c) as You expressly permit in writing.

Where Your use of Services includes the processing of personal data (as described in the EU Data Protection Directive 95/46/EC) within the European Economic Area (EEA), the terms of the data processing addendum at xxxx://xxx.xxxxxxxxxxxxxx.xxx/assets/ffdc/legal/FinancialForce-Data-Processing-Addendum-with-Model- ClausesDocusign.pdf (“DPA”) shall apply to such processing, and shall be incorporated into this Agreement, provided and from the date that You send to xxxxxxx@xxxxxxxxxxxxxx.xxx a copy of the DPA signed by You in accordance with the instructions therein.
Protection of Your Data. Each party shall comply with its respective obligations under applicable data protection laws. Each party shall maintain appropriate administrative, physical, technical and organizational measures that ensure an appropriate level of security for Confidential Information and Personal Data. SolarWinds Worldwide and its Affiliates will process Personal Data in accordance with the Data Processing Addendum. You are responsible for ensuring that the security of the Services is appropriate for Your intended use and the storage, hosting, or processing of Personal Data.
Protection of Your Data. Menusifu will maintain administrative and technical safeguards for protection of the security, confidentiality and integrity of your Data, as described in the Documentation. Those safeguards will include, but will not be limited to, measures for preventing access, use, modification or disclosure of your Data by Menusifu personnel except (a) to provide the Services and prevent or address service or technical problems, (b) as compelled by law in accordance with Section 10.2 (Compelled Disclosure) below, or (c) as you expressly permit in writing.
Protection of Your Data. We will maintain commercially reasonable administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of Your Data. We will not disclose Your Data to any third party or use it for any other purpose not necessary for us to provide the Service or not permitted by our Privacy Policy (xxxxx://xxx.xxxxxxxxx.xxx/privacy). This means that we will restrict access to Your Data to our employees and independent contractors who require access in order to perform hereunder. Our obligations under this section will not apply to the extent that any of Your Data is (a) publicly known at the time of the disclosure or becomes publicly known through no wrongful act or failure of Us, (b) subsequently disclosed to Us on a non- confidential basis by a third party not having a confidential relationship with You that rightfully acquired such information, (c) communicated by Us to a third party with your prior written consent, or (d) disclosed by Us pursuant to a subpoena, court order or request by law enforcement or otherwise required by law (in which case, to the extent We may lawfully do so, We will provide you with written notice of such disclosure to afford You the option to exercise any rights You may have to challenge such disclosure).

Without limiting the above, We shall not (a) modify Your Data, (b) disclose Your Data except as compelled by law in accordance with Section 7.4 (Compelled Disclosure) or as expressly permitted in writing by You, or (c) access Your Data except to provide the Services or prevent or address service or technical problems, or at Your request in connection with support matters.
Protection of Your Data. Without limiting the above, We shall maintain appropriate administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of Your Data as described in the User Guides and/or the applicable. To the extent Your Data includes Personal Data, as defined in the DPA, the terms of the DPA are hereby incorporated by reference and shall apply. To the extent Personal Data from the European Economic Area (EEA), the United Kingdom and Switzerland are processed by Us, the Standard Contractual Clauses shall apply, as further set forth in the DPA. For the purposes of the Standard Contractual Clauses, You and Your applicable Affiliates are each the data exporter, and Your acceptance of this Agreement, and an applicable Affiliate's execution of an order form for Cloud Services, shall be treated as its execution of the Standard Contractual Clauses and Appendices.
Protection of Your Data. Without limiting the above, We shall maintain appropriate administrative, physical, and technical safeguards commonly used in our industry for protection of the security, confidentiality and integrity of Your Data while it is on Our servers or otherwise within Our control. We shall not (a) modify Your Data unless otherwise required in order to provide the Services, (b) disclose Your Data except as compelled by law in accordance with Section 8.4 (Compelled Disclosure) or as expressly permitted in writing by You, or (c) access Your Data except to provide the Services or prevent or address service or technical problems, or at Your request in connection with customer support matters. You recognize and agree, however that transmitting, prospering and hosting data online involves risks of unauthorized disclosure or exposure and that, in accessing the Software Product and using the Services, You assume such risks. FluentPro offers no representation, warranty, or guarantee that Your Data will not be exposed or disclosed through errors or the actions of third parties.
Protection of Your Data. Jungo shall not (a) modify Your Data, (b) disclose Your Data except as compelled by law in accordance with Section 10.4 (Compelled Disclosure) or as expressly permitted in writing by You, (c) access Your Data except to provide the Products or Services or prevent or address service or technical problems, or at Your request in connection with customer support matters, or (d) disclose any personal information supplied by You for any purpose other than the specific purpose of performing the services specified in this Agreement and your Order Form or as otherwise permitted by the California Consumer Privacy Act. Xxxxx’s disclosure of Your Data to an entity that Xxxxx reasonably believes is Your employer or master and the actual owner of the Data after reasonable investigation shall not be deemed a breach of this Section 9.
Protection of Your Data. Your data is processed in compliance with the Data Processing Agreement in Appendix III.
