Neither Elavon nor Member is responsible for the Value Added Services provided by an unaffiliated third party and neither Elavon nor Member is responsible for any Transaction until Elavon receives data for the Transaction in the format required by Elavon. Elavon and Member will be responsible for any third parties retained by Elavon or Member to process Transactions for Merchant, provided that such third parties are identified on Schedule C.
