Penalties, Fees and Exceptions. Customer agrees that RITERATE ENERGY may cancel this Agreement before the end of the Term for the Premises, without penalty or liability to RITERATE ENERGY and without prejudice to enforcement of any legal right or remedy available to RITERATE ENERGY if: (a) Customer fails to pay for Energy hereunder or any other amounts payable on Customer’s Utility xxxx or due to RITERATE ENERGY; (b) Customer attempts to cancel this Agreement after the 10 day rescission period; (c) Customer appoints another person or company as Customer’s Energy supplier or agent; (d) Customer breaches or is in default of any other term of this Agreement; or (e) RITERATE ENERGY is required by law, regulation or legal, regulatory or administrative process to cancel this Agreement; (f) there is a change in legislation, regulation, PUC codes/rules or other PUC documents, or any other change in law (collectively, “Change in Law”) which materially and adversely affects RITERATE ENERGY’s Electricity retailing and/or Gas marketing business; or (g) Customer, or to the extent Customer’s obligations hereunder are guaranteed, Customer’s guarantor: (i) makes an assignment or any general arrangement for the benefit of creditors, or commences or acquiesces in the commencement of a proceeding under any bankruptcy or similar law for the protection of creditors or has such a proceeding commenced against Customer or any such guarantor; (ii) otherwise becomes bankrupt or insolvent (however evidenced); (iii) becomes unable to pay Customer’s debts when due; (iv) has a receiver, trustee or similar official appointed with respect to Customer or substantially all of Customer’s assets.

Penalties, Fees and Exceptions. There is no fee for early termination of this Agreement. You may cancel this Agreement without penalty if you move to another location and provide a forwarding address and, if required, reasonable evidence that you no longer occupy the service address. You will be responsible for amounts due, up to the switch date, of all outstanding charges incurred prior to cancellation by you.
Penalties, Fees and Exceptions. If you do not pay the full amount owed to RiteRate Energy by the due date of the xxxx, RiteRate Energy may charge a late payment fee up to one and one-half percent (1.5%) of the outstanding balance per month, or the maximum legally allowed interest rate, whichever is lower until such payment is received by RiteRate Energy. RiteRate Energy reserves the right to demand adequate assurances from you in the form of prepayment or other form of credit support in the event you fail to make payments in accordance with the terms herein. Customers requiring financial assurance will be required to post that assurance within three (3) business days of notice. Your EDU may charge you a switching fee.

Penalties, Fees and Exceptions. Mass Market (residential and small commercial) customers and customers solicited via Door-to-Door Sales as defined in the New York State Uniform Business Practices: If you cancel or terminate this Agreement prior to the end of the Term, you will pay an early termination fee of no more than $100 if your agreement has a term of less than 12 months remaining and no more than $200 if your agreement has a term of more than 12 months remaining, if applicable to your plan, unless such early termination fee is waived or otherwise modified in writing by Company. The amount of your early termination fee, if applicable, is disclosed in your CDS. You will be responsible for amounts due, up to the switch date, of all outstanding charges incurred prior to cancellation by you. Any early termination fee may automatically be applied to your credit card or bank account depending on the automatic payment arrangements made during enrollment. If you default in the prompt payment of amounts due under this Agreement, you will be liable for any and all fees or charges, including reasonable attorney fees and court costs, incurred in connection with the collection of delinquent balances. Company may use the services of debt collection agencies, consumer reporting agencies, and other remedies as allowed by law to collect any unpaid balances on your account. You will be assessed a fee of $30.00 for payments returned for insufficient funds or credit card transaction not processed due to insufficient funds or credit availability by any method of payment including, but not limited to, bank or personal check, automatic payment plan account deduction or credit/debit card.
