Open Competition. Upon failure to fill the vacancy through a limited competition, the Employer may proceed with an open competition to fill the vacancy.

Open Competition a. It is the intent and purpose of the Purchasing Division that the Price Inquiry permits free and open competition. In the event that the complexity of the Project, schedule requirements or other extenuating circumstances preclude open competition, Contractor may utilize a limited competition solicitation for Subcontractors and Suppliers to provide goods and services to Contractor in accordance with the following:
4.2.1 Contractor must identify and solicit bids from a minimum of three (3) qualified Subcontractors or Suppliers that have the expertise to complete the Work, or any portion of it, in accordance with the performance requirements of this Contract and associated Project documents.
