Local-Level Incentives. The Locality expects to match the COF Grant by the Performance Date with a combination of the following incentives: Category of Incentive: Total Amount Technology Zone tax offsets (Estimated Value) $200,000 Upon a proper application by the Company and approval by the Locality, the Locality will provide the Company with a Technology Zone tax offset for the Facility. The Technology Zone program provides a reduction of at least 50% in the rate for the Business, Professional and Occupational License (“BPOL”) tax, which is a license tax levied by the Locality on a business’s gross receipts for the prior calendar year. If the Company applies to the Locality to qualify for the Technology Zone program, and the Business Tax Division of the Office of the Commissioner of Revenue for the Locality (the “Commissioner of Revenue”) determines that the Company qualifies, then for the purposes of this Agreement, for each year commencing in 2021 and ending in 2023 (based on the Company’s performance in calendar years 2020 to 2022): (i) the Company will file its BPOL tax return with the Commissioner of Revenue on or before March 1, reflecting performance through the end of the prior calendar year; (ii) the Commissioner of Revenue will give notice to the Locality on or before April 30, confirming the dollar value (the “Local Tax Offset”) of the Technology Zone tax offset related to the prior calendar year; and (iii) within 30 days after receiving such notice, the Locality will give VEDP and the Company written notice confirming the Local Tax Offset received by the Company for the prior calendar year. The Company must submit to the Locality a signed Authorization to Release Confidential Tax Information, in the form attached hereto as Exhibit D to authorize the Commissioner of Revenue to release the Company’s BPOL and business tangible personal property tax information to Arlington Economic Development and the Locality’s Department of Management and Finance, beginning with tax year 2019 and continuing for 10 years or the length of Company’s lease of the Facility, whichever is greater. The Locality will treat the tax information as strictly confidential and will not release it to the public, except as part of composite real estate and/or employee-related revenue data.   • Level I If the grievance is not resolved through informal discussions, the supervisor shall give a written decision on the grievance to the parties involved within ten (10) days after receipt of the written grievance.

  • Level II In the event the grievance is not resolved in Level I, the decision rendered may be appealed by the Union to the Superintendent of schools, provided such appeal is made in writing within (20) twenty days in person after receipt of the decision in Level I. If a grievance is properly appealed by the Union to the Superintendent, the Superintendent or designee shall set a time to meet regarding the grievance within fifteen days after receipt of the appeal. Within (20) twenty days after the meeting, the Superintendent or designee shall issue a decision in writing to the Union.

  • Performance Levels (a) The Performance Levels which apply to the performance by the respective Parties of their obligations under this Agreement are set out in Part 1 of Schedule 5.
