Identification of Products. Licensee acknowledges and agrees that Licensee is the marketing organization responsible for the integrity of the Product brand name and representation of Products in the marketplace, and further agrees to use the Xxxx only on Products bearing Licensee’s name or on products granted a Certification Sublicense under paragraph 2.

Identification of Products. SUPPLIER and McDATA hereby agree that Products sold hereunder will be labeled and marketed by McDATA under McDATA’s (or its Customers’) trademarks. SUPPLIER shall have the right to affix and McDATA shall not remove or cover over any nameplate indicating model number, serial number, patent number and/or patent pending legends, and any other markings which may be required by law or by regulatory agencies, where covering over such nameplate would violate any laws, patents, or trademarks.
Identification of Products. Both Parties shall ensure that undertakings in the explosives sector which manufacture or import explosives or assemble detonators shall xxxx explosives and each smallest packaging unit with a unique identification. Where an explosive is subject to further manufacturing processes, manufacturers shall not be required to xxxx the explosive with a new unique identification unless the original unique identification is no longer marked in compliance with Directive 2008/43/EC and/or the Explosives Ordinance. The unique identification shall comprise the components prescribed in the Annex to Directive 2008/43/EC and Annex 14 to the Explosives Ordinance and shall be mutually recognised by both parties. Each undertaking in the explosives sector and/or manufacturer shall be attributed a three-digit code by the Member State's or Swiss national authority where it is established. This three-digit code shall be mutually recognised by both Parties if the manufacturing site or the manufacturer is located in the territory of one of the Parties.

SSRI has experience and expertise in selling Products to the Electrical Industry and in understanding the needs of such industry. The initial phase of the Product development will be the joint identification of potential Products with the highest expectations for success, based on the perceived demand in the Electrical Industry for such Products, the technological feasibility of such Products, the manufacturing costs and potential pricing of such Products, and similar factors deemed critical by the parties, on a cooperative basis by SSRI and Xxxxxx Xxxxx. Xxxxxx Xxxxx shall provide individuals skilled in engineering and the technical aspects of the Technology, and SSRI shall provide individuals experienced and knowledgeable about the Electrical Industry, potential competing products, and marketing in such industry. The Product design team shall work cooperatively to identify and provide the initial design criteria for potential Products for marketing in the Electrical Industry. The parties have agreed to undertake such initial Product identification and design on the time schedule set forth on Exhibit "C" attached hereto and incorporated herein by this reference, as may be amended from time to time by the mutual consent of the parties.

Identification of Products. The analysis of benefits of the PIFCs’ accession to the APTA is examined by using the PIFCs’ exports and imports data. Since the PIFCs are adopting different classification systems while the 4- or 6-digit harmonized commodity description and coding system (HS) is not available for some PIFCs, this study reports trade data at the 2-digit HS level where principal items traded by PIFCs were identified. The HS classifies all products into 99 chapters, which are further grouped in 22 sections. Codes at the chapter and section levels are reported in annex tables A1 and A2, respectively. The latest version of HS classification, with which exports of the most recent two years available are reported, adopted for Fiji, Papua New Guinea, Samoa and Tonga is HS2007; for Solomon Islands is HS1996; and for Vanuatu is HS2002. In this report, trade by product at the chapter and section levels covers two most recent years of 2011 and 2012 for all PIFCs under the study except for Vanuatu for which years 2010 and 2011 are available. Trade data at 2-digit level are extracted from the United Nations Commodity Trade Statistics database (COMTRADE).
