Funding of Special Education Services. Charter School has selected LAUSD SELPA Option 3. The following funding of special education set forth below applies through the end of the Charter School petition. The Charter School’s fair share contribution to special education will be 10% of the charter schools’ AB 602 (rate includes Base, COLA, and Growth/Decline reduced by the amount withheld for Program Specialist/Regionalized Services) and Federal IDEA revenues. This amount will be paid from the Charter School’s Local Control Funding Formula (“LCFF”) funds or other unrestricted revenue sources and will be allocated to support the existing District-wide administration of special education supports and services. The revenue rate will be adjusted to account for changes in the State’s funding formula beginning in fiscal year 2013-14. The amount withheld by the District from the Program Specialist/Regionalized Services in fiscal year will continue to be withheld and adjusted annually for COLA. An additional 10% of special education revenues will be retained by the District and allocated as directed by the Executive Board of Option 3, with the leadership of the Charter-operated Program special education director. These funds will be used to support the personnel for the Charter-operated Program section of the SELPA; build management and operating procedures to create an infrastructure to support schools in meeting the needs of students with mild to severe disabilities; and, to create and implement new programs that serve students in charter schools. If Charter School does not spend their allocation of special education funds during a fiscal year of the charter petition period, the allocation of special education funds to Charter School for the next fiscal year will be reduced in an amount equal to the unspent special education funds from the previous fiscal year. In addition to the payments required under this Section, the Charter School may request specific special education related services from the District through fee-for-service arrangements that will reflect the calculated cost of the requested services and will be contingent on the District’s available resources. Any change in the Option election that occurs during the term of Charter School’s petition period shall be mutually agreed upon and addressed in an MOU between the charter school and the District. The new Option election shall be effective on July 1 of the next school year with the corresponding fair share contribution.

Funding of Special Education Services. The District shall retain all state and federal special education funding allocated to the SELPA for Charter School students. The District shall be responsible for providing all appropriate special education and related services in accordance with applicable state and federal laws for Charter School students as set forth in this MOU. The parties understand and agree that Charter School has an equitable financial contribution obligation under section 47646 of the Education Code. Beginning with the 20 -20  fiscal year, Charter School’s fair share contribution for special education will be 25% of the District’s general fund contribution rate per ADA for that fiscal year which will be paid from the Charter School’s general purpose block grant. This formula will increase by 5% for each fiscal year until the applicable percentage reaches 35%. The rate will remain at 35% for the remainder of the Charter School’s petition period based on the District’s general fund contribution rate for that year. If Charter School does not spend their allocation of special education funds during each fiscal year of the charter petition period, the allocation of special education funds to Charter School for the next fiscal year will be reduced in an amount equal to the unspent special education funds from the previous fiscal year. Any change in the Option election that occurs during the term of Charter School’s petition period shall be mutually agreed upon and addressed in an MOU between the charter school and the District. Funding of Special Education Services. NRS 388A.159(1) deems the State Public Charter School Authority a local education agency (LEA) for the purpose of directing the proportionate share of any money available from federal and state categorical grant programs to charter schools which are sponsored by the State Public Charter School Authority or a college or university within the Nevada System of Higher Education that are eligible to receive such money. However, Special education funding was converted to a weight in the 2017 fiscal year and the additional resources will continue to be expressed as a multiplier and allocated to the Charter School by the Nevada Department of Education on a per-pupil basis (NRS 387.121). Federal IDEA, Part B funding is primarily intended to provide assistance to states and LEAs in carrying out their responsibilities to educate students, age five through twenty-one, with disabilities. Part B grant funds must only be used to pay for the excess cost of providing special education and related services to children with disabilities; to supplement, but not supplant, state, local, and other federal funds. The Authority will, after setting aside funds for required Authority personnel salaries, school training, and other administrative costs, allocate all remaining Part B funds to schools on a reimbursement basis based on the grant application submitted by the charter schools. In the event that a charter school fails to request monthly reimbursement based on the approved grant budget, the Authority reserves the right to reallocate funds to limit the risk of loss of federal funds.
Funding of Special Education Services. NRS 386.513(1) deems the State Public Charter School Authority a local education agency (LEA) for the purpose of directing the proportionate share of any money available from federal and state categorical grant programs to charter schools which are sponsored by the State Public Charter School Authority or a college or university within the Nevada System of Higher Education that are eligible to receive such money. As the LEA, the Authority will receive from the Nevada Department of Education (SEA), state funds on a “unit” basis, with the amount per unit established by the Legislature and, as a sub-grantee, federal IDEA, Part B funds. State “units”, defined by NRS 387.1211, provide funding for licensed personnel who carry out a program of instruction in accordance with minimum standards prescribed by the State Board of Education. The Authority will distribute to Authority sponsored schools, those units allocated to it by the Nevada Department of Education, on a demonstrated needs basis, as determined by the Authority, after thorough evaluation of all applications for units from those schools.   • Special Education Teachers Whenever any Elementary Special Education class to which a student(s) is(are) added as a result of the distribution of students from the class of an absent Elementary Special Education teacher, Article 8-7 shall be in effect. In addition, whenever the class size of the receiving Special Education teacher exceeds the class size maxim mandated by Special Education class size law and/or regulation, the Xxxxxxxx Formula in AAA Case No. 1139-0696- 85, February 21, 1986, shall be used to calculate the compensation which said teacher shall receive as follows: The rate of pay for said teacher for teaching said additional students shall be computed by multiplying the teacher’s daily gross compensation by a fraction in which the denominator is twenty-six (26) and the numerator is the number of children taught in excess of Article 8-1.1 Item 3 of the Collective Bargaining Agreement between the parties.

  • In-Service Education The parties recognize the value of in-service both to the employee and the Employer and shall encourage employees to participate in in-service. All employees scheduled by the Employer to attend in-service seminars shall receive regular wages.

  • Special Education Special education services, related services, and accommodations for students who are eligible under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973 (Section 504), the Americans with Disabilities Act (ADA), or any applicable provisions of state law, shall be provided in accordance with applicable state and federal law, this Agreement and Authorizer rules and policies. The Authorizer is the LEA for purposes of ensuring compliance with IDEA, Section 504, and all other federal and state laws and regulations concerning accommodation of and education of students with disabilities.

  • Administration Services When a medical prescription drug is administered by infusion, the administration of the prescription drug may be covered separately from the prescription drug.
