We are not responsible for any error, damages or other loss you may suffer due to malfunction or misapplication of any system you use, including your browser, your Internet service provider, your personal financial management or other software, or any equipment you may use (including your telecommunications facilities, computer hardware and modem) to access or communicate with the Online Banking Services.

We shall use reasonable efforts to ensure that the Service is secure and cannot be accessed by unauthorized third parties. We are not liable for any failure to make transfers to or from your Accounts, or for transfers made in the wrong amount. In addition, you agree to indemnify, defend, and hold the Bank, our affiliates, officers, directors, employees, consultants, agents, service providers, and licensors harmless from any and all third party claims, liability, suits, fines, penalties, losses, proceedings, damages and/ or costs (including but not limited to reasonable attorneys’ fees) arising from (a) any fraud, manipulation, or other breach of this Service Agreement by you; (b) any third party claim, action, or allegation brought against us arising out of or relating to a dispute with us over the terms and conditions of this Service Agreement; (c) your violation of any laws or regulations or the rights of a third party; or (d) the use of the Service by any third party.   • Equipment and Software To use the Mobile Remote Deposit Services, you must obtain and maintain at your expense, compatible equipment and software that we may specify from time to time.

  • SERVICE MONITORING, ANALYSES AND ORACLE SOFTWARE 11.1 We continuously monitor the Services to facilitate Oracle’s operation of the Services; to help resolve Your service requests; to detect and address threats to the functionality, security, integrity, and availability of the Services as well as any content, data, or applications in the Services; and to detect and address illegal acts or violations of the Acceptable Use Policy. Oracle monitoring tools do not collect or store any of Your Content residing in the Services, except as needed for such purposes. Oracle does not monitor, and does not address issues with, non-Oracle software provided by You or any of Your Users that is stored in, or run on or through, the Services. Information collected by Oracle monitoring tools (excluding Your Content) may also be used to assist in managing Oracle’s product and service portfolio, to help Oracle address deficiencies in its product and service offerings, and for license management purposes.

  • Your Equipment All equipment and facilities provided by you for use with your Services is “Customer Equipment.” You are solely responsible for installing, maintaining, configuring, repairing, replacing, upgrading and using your Customer Equipment. Astound has no responsibility whatsoever with respect to your Customer Equipment. If your Customer Equipment impairs the Services, you will remain liable for payment of the applicable Fees for your Services. If, at your request, Xxxxxxx should attempt to resolve difficulties caused by your Customer Equipment, such efforts will be performed at Astound’s discretion and at Astound’s then- current standard hourly rates for such work. Any Customer Equipment you use in connection with the Services must meet Astound’s then-current minimum technical and other requirements.

  • COMPUTER SOFTWARE The Grantee certifies that it has appropriate systems and controls in place to ensure that state funds will not be used in the performance of this Grant Agreement for the acquisition, operation, or maintenance of computer software in violation of copyright laws.

  • Computer Equipment No computers and/or personal electronic devices, such as tablets and laptop computers, or any component thereof, may be purchased with funds provided under this Contract, regardless of purchase price, without prior written approval of ADMINISTRATOR. Any such purchase shall be in accordance with specifications provided by ADMINISTRATOR, be subject to the same inventory control conditions specified above in Subparagraphs 18.1.1 to 18.1.4, and, at the sole discretion of ADMINISTRATOR, become the property of COUNTY upon termination of this Contract.
