Time of Delivery of the Goods. The Supplier shall provide the Goods on the date(s) specified in the Call Off Order Form (or elsewhere in this Call Off Contract) and the Milestone Dates (if any). Subject to Clause 9.2.3 (Time of Delivery of the Goods), where the Goods are delivered by the Supplier, the point of delivery shall be when the Goods are removed from the transporting vehicle and transferred at the Sites. Where the Goods are collected by the Customer, the point of delivery shall be when the Goods are loaded on the Customer's vehicle. Where the Customer has specified any Installation Works in the Call Off Order Form, Delivery shall include installation of the Goods by the Supplier Personnel at the Sites (or at such place as the Customer may reasonably direct) in accordance with Clause 10 (Installation Works) and the Call Off Order Form. Location and Manner of Delivery of the Goods Except where otherwise provided in this Call Off Contract, the Supplier shall deliver the Goods to the Customer through the Supplier Personnel at the Sites. If requested by the Customer prior to Delivery, the Supplier shall provide the Customer with a sample or samples of Goods for evaluation and Approval, at the Supplier’s cost and expense. The Goods shall be marked, stored, handled and delivered in a proper manner and in accordance the Customer’s instructions as set out in the Call Off Order Form (or elsewhere in this Call Off Contract), Good Industry Practice, any applicable Standards and any Law. In particular, the Goods shall be marked with the Order number and the net, gross and tare weights, the name of the contents shall be clearly marked on each container and all containers of hazardous Goods (and all documents relating thereto) shall bear prominent and adequate warnings. On dispatch of any consignment of the Goods the Supplier shall send the Customer an advice note specifying the means of transport, the place and date of dispatch, the number of packages, their weight and volume together with the all other relevant documentation and information required to be provided under any Laws. The Customer may inspect and examine the manner in which the Supplier supplies the Goods at the Sites and, if the Sites are not the Customer Premises, the Customer may carry out such inspection and examination during normal business hours and on reasonable notice.

Time of Delivery of the Goods. The Supplier shall provide the Goods on the date(s) and times(s) specified in the Order Form and the Milestone Dates (if any) or the Purchase Order. Deliveries shall be made into the Customer’s Mechanical Transport Fuel Installations (MTFIs) located at the Units listed in Call Off Schedule 8. Subject to prior arrangement between the Customer and Supplier, deliveries may also be made to the Customer’s Bulk Fuel Carrying Vehicles (BFCVs) whilst situated at the MTFIs designated in Call Off Schedule 8. The Supplier’s BFCVs are required to connect via standard 4” Quick Release Couplings. The delivery date shall be: a maximum of three (3) working days from the date of the order: or as agreed between the Customer and Supplier Subject to Clause 8.3.7 where the Goods are delivered by the Supplier, the point of delivery shall be when the Goods are removed from the transporting vehicle and transferred into the Customer’s storage tank at the Premises. Where the Goods are collected by the Customer, the point of delivery shall be when the Goods are loaded on the Customer's vehicle. If so specified by the Customer in the Order Form or Purchase Order, time of delivery in relation to the provision of the Goods (including any Installation Works) shall be of the essence and if the Supplier fails to Deliver the Goods at the time or within the time period specified in accordance with Clause 8.2.1 (and without prior Approval) the Customer may release itself from any obligation to accept and pay for the Goods and/or be entitled to terminate this Call Off Contract for Material Breach, in either case without prejudice to any other rights and remedies of the Customer under this Call Off Contract or at Law.
