Subpoena/Witness Service. Any employee subpoenaed to appear in an administrative or legal proceeding or to give a deposition related to a service call or customer contact shall be granted time off without loss of pay or benefits if the testimony relates to the employee’s work and/or duties with the Company. Employees who have a normally scheduled shift that ends after midnight will be granted the shift prior to and immediately following the start of their service off. Twenty-four hour shift employees shall be granted the night half of their shift off prior to the administrative or legal proceeding. An employee who is not scheduled to work and is subpoenaed shall be paid for time spent to a maximum of four (4) hours for each day spent at the administrative, legal proceeding, or deposition. Such time shall be counted as time worked. The employee must submit documentation reflecting the time spent in compliance of said subpoena to their Operations Manager or designee in order to receive payment for such time. If the employee is excused from his/her subpoena obligation and more than four (4) hours remain in the employee’s regularly scheduled work day, the employee shall return to work. Employees shall not be compensated for missed work hours when subpoenaed by or on behalf of a present or past employee of the Employer to testify in a legal or administrative proceeding initiated by the present or past employee against the Employer. However, the Employer shall ensure the employee is allowed time off for the legal or administrative proceeding in response to the subpoena and the employee may use accrued PTO to cover the absence.

The 875 employee must submit documentation representing time spent in compliance of said subpoena to 876 their Operations Manager upon their return to work in order to receive payment for such time. 877 878 If the employee is excused from his/her obligation and more than four (4) hours remain in the 879 employee’s regularly scheduled workday, the employee shall return to work. The Employer shall 880 notify the employee within twenty-four (24) hours of the receipt of a subpoena at the Employers 881 operation. 882 883 Employees shall not be entitled to pay under this provision if a trial or proceeding that initiates 884 the subpoena is by or on behalf of a present or past employee that has initiated litigation towards 885 the Employer or if the incident giving rise to subpoena is not work related, however, the 886 Employer shall insure that the employee is allowed the time off for such proceeding and that the 887 employee may request to use vacation hours for their time off. Any employee called upon by or 888 on behalf of the Employer will be compensated, as hours worked, by the Employer for witness 889 time and any resulting lost work time.
Subpoena/Witness Service. All full-time employee who is subpoenaed by a court of law for work related matters will receive up to a three (3) days pay (not to exceed eight (8) hours) as time worked for any regularly scheduled shift(s) they are required to miss.

  • Civil Service 2.6.1 The Government of National Unity shall also ensure that the National Civil Service, notably at the senior and middle-levels, is representative of the people of Sudan. In so doing, the following principles shall be recognized:-
