Preservation of Benefits. The Employer agrees not to make changes to State statutes, administrative rules, regulations, guidelines, TSHRS or policies that are mandatory subjects of bargaining per the law until negotiated in accordance with this agreement (Article 35).
Preservation of Benefits. Nothing contained herein shall be construed to deny any employee of his/her rights under state law or under State Board Rules or Board Policies. In addition to salary benefits, as provided in Appendix D, the Board shall provide compensatory benefits. These benefits, as implemented by resolution, policies, rules, directives and memoranda in effect on the date this Agreement is executed, shall not be changed, modified, or repealed during the term of this Contract without mutual consent of the parties.

All benefits presently enjoyed by employees covered by this Memorandum of Understanding which are not specifically provided for or abridged in this Memorandum, such as but not limited to holidays, uniforms, equipment, etc., are hereby included and protected by this Memorandum.

With respect to matters not covered by this Agreement, the Employer will not seek to diminish or impair during the term of this Agreement any benefit or privilege provided by law, rule or regulation for employees without prior notice to the Union when appropriate, without negotiations with the Union provided, however, that this Agreement shall be construed consistent with the free exercise of rights reserved to the Employer by Article IV of this Agreement.

In addition to salary, as provided elsewhere in this Agreement, the School Board and Union agree that the Fringe Benefits agreement is subject to change based upon results of negotiations concerning Fringe Benefits in subsequent years.
Preservation of Benefits. Nothing in this Agreement shall limit or replace the compensation or benefits payable to Executive, or otherwise affect Executive’s rights, under any other benefit plan, program or agreement in which Executive participates or to which Executive is a party.
Preservation of Benefits. Bargaining unit members who presently receive base salary or hourly rates which are greater than the applicable minimum base salaries and hourly rates set forth in this Agreement shall not have their base salary or hourly rate reduced.

Preservation of Benefits. Nurses who are laid off may elect to continue group health, dental and vision insurance coverage for themselves and their dependents. However, the premium cost for such coverage shall be paid by the Nurse as of the first of the month following the Nurse’s layoff.
