Government Projects. The agency shall notify the contractor when agency projects are to be implemented that may impact the installation or operations of contractor-installed ECMs. If the agency project affects annual energy savings, then the agency will determine whether to adjust the savings calculation methodology in the M&V plan, or negotiate a baseline change, or implement some other corrective methodology.

Government Projects. The Government shall not be restricted from implementing equipment installation, construction projects and ECMs independent of work performed under this Agreement, including installing new energy conservation equipment, removing existing energy consuming equipment, or adding new energy consuming equipment. The Government will notify the Utility prior to implementing projects that may affect ECMs under this Agreement.

Government Projects. For certain Services, ACHAOGEN may engage HOVIONE as a subcontractor to certain projects under the Prime Contract by mutual execution of a Work Plan. Any Work Plan under which HOVIONE is acting as a subcontractor shall be a “Government Project”, and such Government Projects will be expressly identified as such within the applicable Work Plan. For the avoidance of doubt, the commercial Manufacturing and supply of the Product shall not be a Government Project.

Government Projects. The Company contracts with the Buyer as work for hire, not with the Government entity. Products supplied by The Company in connection with government projects will comply with the applicable published government specifications as identified in the proposal at time of contract award. It is the Buyer’s responsibility to ensure that the Products supplied by The Company meet the Buyer’s contractual obligations with the Government. If the Buyer requires The Company to provide more data, or supplement information over and above government contract requirements, the consequential costs will be separately invoiced to the Buyer.
