The agreement of the Agency, shall be requested only after the Contractor has submitted the corresponding justification via Astrium. For the purpose of the Agency Project defined in the Contract, the prior written consent from the Contractor, referred to under the present Sub-Clause 38.2 and Clause 43.8, is not required and the Agency may circulate such documentation or software to consultants (subject to confidentiality agreement) and to employees that require that documentation or software for the purpose of complying with the Contract for using, modifying or maintaining any product, application or result within the frame of the GMES programme.
