Award of Vacancies. In making the decision to award a vacancy, the District will consider the certification, job classification, qualifications, skills, attendance, discipline records, evaluations, and experience of the applicants (internal and external), including the length of service in the District and other factors relevant to the applicant's ability to perform essential job functions. If two (2) applicants are reasonably equal with regard to the foregoing selection standards, the applicant with the most seniority in the classification where the vacancy exists will be awarded the vacant position. The applicant selected shall be notified of his/her selection and the time and place to report for work. The decision of the District in filling the position shall be final.

Award of Vacancies. Any bargaining unit member may apply for any posted vacancy. The most senior bargaining unit applicant in the same classification as the vacancy shall be awarded the vacancy. If no bargaining unit members from the classification of the vacancy apply, the bargaining unit member applicant who, in the opinion of the Board, is most qualified shall be awarded the vacancy. If two or more bargaining unit member applicants are considered by the Board to be equally qualified, the most senior shall be awarded the position. If no bargaining unit member applies, or no bargaining unit member applicants are considered by the Board to be qualified to fill the position, it may be filled by a new hire.

Qualified shall be interpreted to mean the employee possesses the skills and abilities to perform the tasks required by the position or possesses skills and abilities necessary to learn the task in a ten (10) day work period. Award of Vacancies. The parties share the common goal of ensuring that all positions are filled by the very best candidates available. All positions will be posted simultaneously both internally and externally. Vacancies shall be filled with the bargaining unit member from within the existing bargaining unit who is the most senior applicant who is qualified for the position, unless an internal or external candidate presents who better meets the qualifications for the position. Provided, however, in the event the Board deems two (2) or more applicants to be equally “best qualified,” and if at least one of the equally “best qualified” applicants has accumulated seniority in the classification of the vacant position, then the vacant position shall be awarded to the bargaining unit member with the most seniority in the classification of the vacant position. Qualifications for the position must be based on the job description and may, at the discretion of the Board or Superintendent, also take into account the special needs for the student needing an aide, if applicable. Qualifications for the vacant position shall be clearly articulated on the posting notice. The administration will make the final determination regarding which candidate is best qualified for a position based upon the job description. The Administration reserves the discretionary right to elect to reject all applicants based on lack of qualifications and re-post the position, provided, however, that this shall not preclude any bargaining unit member from re-applying for the position.

Any bargaining unit member who has served more than twenty (20) consecutive workdays in a classification within the past two (2) years shall be determined qualified for any position in that classification. Except as provided for above, the Board, at its option, may hire the most qualified applicant for the position, including outside applicants. Consideration shall be given to bargaining unit members in the filling of all other vacancies.
