Additional Expansion Space. Whenever, after January 1, 1999, an office area (the "New Space") next to and adjoining the Premises is or becomes vacant then, as long as Tenant is not in material default hereunder beyond any applicable cure period, and subject to any other tenant's right of first refusal under the other tenant's lease with Landlord, Tenant, at its option, shall have a right to expand into the New Space after entering into a lease for the New Space, upon the terms and conditions as set forth herein. Landlord shall notify Tenant: a) that the New Space is or is becoming vacant and b) the market rent and term for the New Space. Tenant, at its option, may within ten (10) business days after Landlord's notice, notify Landlord that Tenant desires to rent the New Space from Landlord at the market rent for the term indicated. If Tenant does not timely and properly notify Landlord that Tenant desires to rent the New Space at the market rent and term, then Tenant shall be deemed to have waived its right to expand and rent the New Space. If Tenant property notifies Landlord that Tenant desires to rent the New Space at the market rent and term, then Landlord shall promptly prepare and send to Tenant a lease for the Tenant to execute, said lease to be for the Tenant to rent the New Space at the market rent and term and in a form similar to the main body of this Lease. Tenant - at its option - may within ten (10) business days thereafter, execute and return to Landlord the lease for the New Space. If Tenant properly and timely executes and returns to Landlord said lease for the New Space, then Landlord shall execute the lease and said lease for the New Space shall be binding upon the parties. If Tenant does not properly and timely execute said Lease, then the Tenant shall have waived its option to expand into the New Space, and Landlord shall have the right to lease the New Space to any third party of Landlord's choosing. Additional Expansion Space. Tenant shall lease an additional 4,818 rentable square feet and 4,236 usable on the ground floor of the 27442 building ("Additional Expansion Space"). This expands their currently occupied space to a new total rentable square footage of 24,734. This is depicted on the floor plan attached to this Amendment as Exhibit "A" and incorporated herein by this reference, for a term equal to the men unexpired portion of the Lease Term of the Premises, whereupon the space shall be deemed a part of the Premises. Tenant's lease of the Additional Expansion Space shall be subject to all of the terms of the Lease except: (i) as specified below in this Amendment; (ii) the Basic Rent for the Additional Expansion Space shall be as described in Paragraph E of the Amendment; (iii) the Operating Expense Base Year shall be the same as is provided for the Premises; and (iv) effective as of the Commencement Date for the Additional Expansion Space, Landlord shall provide Tenant with additional unreserved parking according to the provisions of Paragraph 121 of the Lease.
Additional Expansion Space. Provided that this Lease shall be in full force and effect and Tenant shall not be in default hereunder beyond any applicable notice and grace period, Tenant shall have the ability, exercisable by written notice to Landlord ("Tenant's Notice") given at any time during the initial Term (but provided to Landlord at least 120 days prior to the date Tenant desires to occupy additional space in the Building, the time of the giving of such notice to be of the essence of this Paragraph) to request the lease of additional space in the Building. Tenant agrees that Tenant's Notice shall set forth the number of additional rentable square feet of space Tenant desires to lease, which shall be at least a minimum of 5,000 rentable square feet and shall not exceed a maximum of 5,000 rentable square feet. Landlord shall have 30 days from the date it receives Tenant's Notice to evaluate and determine, in its sole discretion, what Available Space, as defined below in subparagraph D, if any, then exists in the Building and to provide written notification thereof to Tenant ("Landlord's Notice"). If Landlord's Notice so identifies Available Space in the Building, Tenant shall have 5 calendar days from the date of Landlord's Notice to notify Landlord, in writing, of its election to either accept or reject the Available Space ("Tenant's Response Notice").
Additional Expansion Space. The parties herby acknowledge and agree that Paragraph 35 of the Lease entitled "Tenant's Ability to Request Additional Expansion Space" shall hereby be deemed modified such that, notwithstanding anything to the contrary contained in said Paragraphs 35 or elsewhere in the Lease, at Landlord's option the Additional Expansion Space(s), as defined in Paragraph 35, may be located in additional buildings constructed by Landlord, at its sole election, as part of the Building Complex.

Additional Expansion Space. Landlord leases to Tenant, and Tenant leases from Landlord, additional space located at 7000 Xxxxxx Xxxxxx, Houston, Harrxx Xxxnty, Texas. The additional area of approximately 6,141 rentable square feet shall be Suite 2000. Landlord and Tenant agree that the space is to be used for general office and administrative space. Landlord also leases Tenant and Tenant leases from Landlord 2,450 rentable square feet to be used for storage space. Such space is not Building Standard and Tenant is not entitled to any buildout allowance. With this additional space Tenant will occupy the entire 19th, 20th and 21st floors. 2 3.
Additional Expansion Space. Tenant shall use the Unimproved Space solely for storage space by Tenant and for no other purpose. Tenant acknowledges and agrees that the Unimproved Space is leased by Tenant "as is," that Landlord has no obligation to construct or to pay for the construction of any improvements on the Unimproved Space and that if any improvements are made to the Unimproved Space they shall be made at Tenant's sole cost and expense. Notwithstanding any provision in this Lease to the contrary, Landlord shall have the right at any time during the term of this Lease to terminate Tenant's occupancy and lease of the Unimproved Space, which at the time of termination remains unimproved, by delivering thirty (30) day advance written notice thereof to Tenant."
Additional Expansion Space a. Tenant will begin leasing 4,002 square feet on the second floor of Building 4250, as outlined on Exhibit "C", attached hereto and incorporated herein by reference. The term for the Additional Expansion Space shall be from October 1, 1998 through September 30, 2003.
