7Local principles. The Trust and the Council recognise that good quality information is fundamental to effective treatment and care, and that information about service users needs to be shared for the SAMHS to function effectively. They also recognise that carers play a vital role in helping to look after mental health service users, particularly those with severe mental illness. Information needs to be shared between carers and the service in order to provide more effective care and to support and protect the carer. In sharing information about service users both organisations will adhere to the following principles: Information will be treated as confidential when it is reasonable to assume that the provider of the information believed that this would be the case. The sharing of personal information will normally be with the consent of the service user. At the initial point of contact with the SAMHS, or as soon as possible thereafter, service users will have explained to them: The purpose of collecting their personal information and how we use that information The rights they have in relation to their information, for example, rights of access, and rights to have inaccurate information corrected That their personal information will be treated as confidential, however, it may be necessary to share that information with other staff That their personal information may need to be shared between the Trust and the Council When their personal information is shared between the Trust and the Council it will be in accordance with the provisions of this protocol How to complain should they feel that their personal information has been used inappropriately Following this explanation, their consent to the use and sharing of this information will normally be sought. Where a service user is unable to give consent due to their physical or mental condition, the decision to share information should be made on the service user's behalf by those responsible for providing care or treatment, taking into account the views of relatives or carers. In making that decision, the service user's interests are paramount. In cases of doubt, advice should be sought from an appropriate senior member of staff. The reasons for the decision should be clearly recorded. Where a service user wants information about them withheld from another person or organisation, which otherwise might have received it, every effort should be made to explain to the individual the consequences for treatment and care.
