Service Provider is not responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of the Customer Data over communications networks and facilities, including the internet, and the Customer acknowledges that the Services may be subject to limitations, delays, and other problems inherent in the use of such communications facilities.
Except for any explicit obligations under this MSA or Applicable Law, including the Data Protection Legislation, the Customer acknowledges that Service Provider has no control over the Customer Data hosted as part of the provision of the Cloud Services, and will not actively monitor or have access to the Contents of such Customer Data.
The Customer warrants that the use of the Cloud Services and any Customer Data will be in accordance with this MSA (including any related Service Order) and all Applicable Law.
For any Customer Data that the Customer uploads, stores or shares, the Customer hereby represents and warrants that it either owns or has the authority, including all rights, licences, consents and releases, that are necessary to enable their use.
The Customer is solely responsible for any Customer Data, including any Personal Data, financial, health or governmental information, or any other information which may be subject to Data Protection Legislation.
