Building Elements definition

Building Elements means the structural elements of the Building, together with those portions of the building systems therein which provide electrical, gas, water and sewer services to the Building for general warehouse and office uses (as opposed to such systems which are specific to the particular uses of Tenant). Building Elements expressly excludes all Tenant Improvements and Tenant Equipage. In illustration of the foregoing, the general electrical and plumbing systems providing electrical service to a main breaker box and making water and sewer service available to common lavatories and washbasins are Building Elements, distribution wiring to work areas and plumbing and sewer work to operational areas of the Premises are Tenant Improvements and any specialized wiring and plumbing unique to a particular activity being conducted by Tenant in the Premises are Tenant Equipage.
Building Elements means the components of the Development which would have existed regardless of the requirement to provide Public Art, including, landscaping, lighting, and components of the Assessable Building;

Examples of Building Elements in a sentence

  • Tenant’s failure to give such written notice to Landlord within one hundred twenty (120) days after the Lease Commencement Date shall constitute a conclusive presumption that the Premises and all Building Elements were in good working order and condition as of the Lease Commencement Date.

  • Landlord shall be entitled in such event to receive the entire award for the Land and Building Elements so taken or condemned which may be made in such condemnation proceeding, and Tenant shall not be entitled to receive any portion thereof.

  • In any such event, all Rent payable hereunder shall be apportioned to the date of such damage or destruction and Landlord shall be entitled to receive and retain all insurance proceeds relating to the Building Elements payable by reason of such occurrence.

  • Tenant may not make any change, alteration, addition, restoration or improvement in, to or of the Building Elements other than Minor Building Alterations (herein collectively referred to as a "Major Building Alteration") without first, in each instance, obtaining the written consent of Landlord and compliance with the provisions of Section 10.3.3. below.

  • In the case of any of Tenant's Specialized Improvements/Base Building Upgrades or Subsequent Alterations and Improvements which are Base Building Elements similar in nature to TSI/BBU, Tenant may, at its option, prior to surrendering the Premises, remove such improvements or the relevant components thereof and replace the same with standard versions.

  • Landlord shall not be obligated to restore any of Tenant's Fixtures and Equipment or Subsequent Alterations and Improvements constructed by Tenant in the Premises which are not Base Building Elements.

  • All awards, damages and compensation on account of any such taking of the Premises (including (a) Tenant's Specialized Improvements/Base Building Upgrades and (b) any Subsequent Alterations and Improvements made by Tenant which are Base Building Elements) shall belong and be payable to Landlord.

  • The Space Planner shall prepare all space plans, working drawings, and plans and specifications described in Paragraph B.3, below, in conformity with the plans for the Base Building Elements, and the Space Planner shall coordinate its plans and specifications with the Engineers (hereinafter defined) and Landlord.

  • Landlord shall repair, or cause to be repaired or replaced, at its sole cost and expense, any defects or damage to the Building Shell Work, Base Building Elements, or Tenant Improvements due to defective materials or workmanship in construction thereof or nonconformance with the plans and specifications approved as provided in Sections 2.1 and 2.2 of the Original Lease.

  • Base Building Elements are distinguished from and do not include additional special fixtures, furnishings and equipment installed to meet the requirements of Tenant's particular business or uses.

Related to Building Elements

  • Building Common Areas means with respect to the Tower, the areas, facilities and amenities specified in Schedule [E] which are to be used and enjoyed in common with all the other Apartment Acquirers of the Units in the Building; and

  • Building Project means the aggregate combined parcel of land on a portion of which are the improvements of which the Premises form a part, with all the improvements thereon, said improvements being a part of the block and lot for tax purposes which are applicable to the aforesaid land.

  • Base Building shall include the structural portions of the Building, the public restrooms and the Building mechanical, electrical and plumbing systems and equipment located in the internal core of the Building on the floor or floors on which the Premises are located. Tenant shall promptly provide Landlord with copies of any notices it receives regarding an alleged violation of Law. Tenant shall comply with the rules and regulations of the Building attached as Exhibit E and such other reasonable rules and regulations adopted by Landlord from time to time, including rules and regulations for the performance of Alterations (defined in Section 9).

  • Common Area means all areas and facilities within the Project that are not designated by Landlord for the exclusive use of Tenant or any other lessee or other occupant of the Project, including the parking areas, access and perimeter roads, pedestrian sidewalks, landscaped areas, trash enclosures, recreation areas and the like.

  • the Building means any building of which the Property forms part.

  • Building means any structure used or intended for supporting or sheltering any use or occupancy.

  • Common Areas is defined as all areas and facilities outside the Premises and within the exterior boundary line of the Project and interior utility raceways and installations within the Unit that are provided and designated by the Lessor from time to time for the general non-exclusive use of Lessor, Lessee and other tenants of the Project and their respective employees, suppliers, shippers, customers, contractors and invitees, including parking areas, loading and unloading areas, trash areas, roadways, walkways, driveways and landscaped areas.

  • Building Drain means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five (5) feet (1.5 meters) outside the inner face of the building wall.

  • Heritage Building means a Building designated under Part IV of the Ontario Heritage Act, R.S.O. 1990, c. O.18, or any successor legislation, or a Building designated under Part V of the Ontario Heritage Act,R.S.O. 1990, c. O.18, or any successor legislation, which has been identified as a significant heritage resource in a conservation district plan and any Building listed in the Markham Register of Property of Cultural Heritage Value of Interest;

  • Buildings means any and all buildings, structures, garages, utility sheds, workrooms, air conditioning towers, open parking areas and other improvements, and any and all additions, alterations, betterments or appurtenances thereto, now or at any time hereafter situated, placed or constructed upon the Land or any part thereof.

  • Building Systems The mechanical, electrical, plumbing, sanitary, sprinkler, heating, ventilation and air conditioning (“HVAC”), security, life-safety, elevator and other service systems or facilities of the Building up to the point of connection of localized distribution to the Premises.

  • mixed-use building means a building or structure containing a residential and non- residential use other than a home occupation;

  • Base Building Work means the base building work for the Building as described in this Manual.

  • Building Work has the meaning given to it in section 6 of the Building and Construction Industry (Improving Productivity) Act 2016 (Cth);

  • Building Area means the greatest horizontal area of a building within the outside surface of the exterior walls.

  • Building Plans mean the general building plans and specifications in respect of the Development or in respect of any part or parts of the Development prepared by the Authorized Person and approved by the Building Authority and include any approved amendments thereto;

  • Building system means plans, specifications and documentation for a system of manufactured factory-built structures or buildings or for a type or a system of building components, including but not limited to: structural, electrical, mechanical, fire protection, or plumbing systems, and including such variations thereof as are specifically permitted by regulation, and which variations are submitted as part of the building system or amendment thereof.

  • Building Square Footage or "BSF" means the square footage of assessable internal living space of a Unit, exclusive of any carports, walkways, garages, overhangs, patios, enclosed patios, detached accessory structure, other structures not used as living space, or any other square footage excluded under Government Code Section 65995 as determined by reference to the Building Permit for such Unit.

  • apartment building means a residential use building, or the residential use portion of a mixed-use building, other than a townhouse or stacked townhouse containing four or more dwelling units each of which shall have access to above grade common halls, stairs, elevators, and yards;

  • Office Building (Premises), means a building or premises or part thereof whose sole or principal use is for an office or for office purposes or clerical work. "Office purposes" includes the purpose of administration, clerical work, handling money, telephone, telegraph and computer operation; and "clerical work" includes writing, book-keeping, sorting papers typing, filing, duplicating, punching cards or tapes, machines calculations, drawing of matter for publication and editorial preparation of matter for publication.

  • Parking Structure means a Building, or any part thereof, principally used for the parking of motor vehicles;

  • Building Equipment shall have the meaning set forth in the Security Instrument.

  • Common Areas and Facilities means collectively the Development Common Areas and Facilities and the Residential Common Areas and Facilities and all those parts and such of the facilities of the Development designated as common areas and facilities in any Sub-Deed;

  • Building site means a plot of land held for building purposes, whether any building is actually erected thereupon or not, and includes the open ground or courtyard enclosed by, or adjacent to, any building erected thereupon;

  • Outbuilding means and refer to structures such as (by way of example and not limitation) storage buildings, sheds, greenhouses, gazebos and other Roofed Structures.

  • Parking Areas means those portions of the Common Areas or other areas under Landlord’s control which from time to time are designated by the Landlord for the parking of automobiles and other automotive vehicles while engaged in business upon the Premises (other than while being used to make deliveries to and from the Premises).
