Warranty of Products. Contractor warrants that the products supplied conform to the specifications requested, are fit and sufficient for the purpose manufactured, are of good material and workmanship, and are free from defect. The length of warranty may vary by product. Contractor further warrants that the products are new and unused and of the latest model or manufacture, unless the Department specifies otherwise. Contractor acknowledges that exceptions will be rejected.

IN NO EVENT SHALL VODAVI BE LIABLE FOR LOSS OF ANTICIPATED PROFITS, INCIDENTAL OR CONSEQUENTIAL DAMAGE, LOSS OF TIME, OR OTHER LOSSES INCURRED BY PARADIGM IN CONNECTION WITH THE PURCHASE, POSSESSION, OPERATION, OR USE OF THE PRODUCTS, SUCH CLAIMS BEING HEREBY EXPRESSLY WAIVED BY PARADIGM.
Warranty of Products. MATERIALS / EQUIPMENT ("PRODUCTS")
Warranty of Products. Atlantis and Potter represent and warrant that all of the products to be supplied to KAA hereunder shall be manufactured in accordance with industry standards all applicable governmental rules and requirements and shall be fit for the use intended. Atlantis and Potter agree to indemnify and hold KAA and all of its affiliates harmless from and against any claim that the products do not comply with industry standards. Atlantis and Potter further agree to obtain product liability insurance in amounts requested by KAA with respect to product liability and other matters arising out of the manufacture and providing the products to KAA by Atlantis.

Warranty of Products. 17.1. The Purchaser agrees and acknowledges that the following specific terms apply to the supply of the respective type of Products:
Warranty of Products. Unless the Contract expressly states otherwise, Contractor warrants that all Products will: (i) be of first-rate quality and in accordance with the highest recognized standards in Contractor’s industry; (ii) be new, unless the Contract expressly provides otherwise; (iii) be, and use only materials or components, of the kind, make, and quality specified in the Contract; (iv) be free from defects in design, workmanship, or materials; (v) comply with applicable law and industry codes or standards; (vi) conform to, and perform per, Contract requirements (including a performance guarantee) or implied warranty under applicable law; (vii) be merchantable, safe, and appropriate for their normal purpose; and (viii) if Contractor knows or has reason to know of Company’s intended use, be fit for the particular purpose. Contractor warrants that all Products, including installation, will comply with this Warranty of Products clause for the longer of: (a) Contractor’s or manufacturer’s standard warranty period; (b) the warranty period stated in the Contract; or (c) one year after warranty start. All replacement Products provided as warranty Services must comply with this clause as well.
Warranty of Products. Based on the Marketing Plan and Analysis and the Production Plan, the parties shall establish the terms and conditions of the warranties to be provided to the end user of the Products by Xxxxxx Xxxxx and the terms and conditions of any support and maintenance program to be offered to end users of the Products by Xxxxxx Xxxxx, Xxxxxx Xxxxx will provide all services required by the warranty and support agreements in a commercially reasonable manner. Xxxxxx Xxxxx shall also make available an employee to sit on boards or committees in which SSRI is a member that establish or recommend standards in the Electrical Industry.
