Tenant’s Improvement Allowance. In addition to Landlord’s performance of the Work specified in § 5.1.1 above, Landlord agrees to make available to Tenant an improvement allowance in the amount of Ten Thousand Dollars ($10,000.00) (the “Allowance”) to be utilized by Tenant to pay the cost of any Tenant’s Work that Tenant may elect to complete in the Premises in connection with its preparations for the occupancy of the Premises. Landlord agrees to reimburse Tenant for the cost of the Tenant’s Work, up to the maximum amount of the Allowance, promptly after receipt from Tenant of invoices, paid receipts, and such other documentation as Landlord may reasonably require in connection with Tenant’s completion of Tenant’s Work. Tenant agrees that the Allowance shall be repaid to Landlord as Additional Rent in monthly installments of Thirty Dollars and Eighty Eight cents ($30.88) per month for each increment of One Thousand Dollars ($1,000) or part thereof that Tenant elects to draw of the available Supplementary Allowance as provided herein, which increase assumes an amortization period of three (3) years Tenant agrees promptly to execute and deliver to Landlord an amendment to the Lease to reflect the increase in the Rent thereunder which results from the utilization of the Allowance described herein as soon as the amount of such increase is liquidated and as soon as such amendment is presented to Tenant for execution. The increase shall be deemed an item of Additional Rent under § 2.3 above. Tenant agrees that the unamortized portion of the Supplementary Allowance shall be immediately due and payable to Landlord if Tenant defaults under the Lease or if the Lease terminates for any reason prior to the Expiration Date specified in the Table in the Lease.

Tenant’s Improvement Allowance. 4th Floor Premises Tenant Improvement Allowance: $ 931,840.00 (23,296 usable square feet x $40.00) 3rd Floor Phase II Premises Tenant Improvement Allowance: $ 465,920.00 (11,648 usable square feet x $40.00) 3rd Floor Phase III Premises Tenant Improvement Allowance: $ 465,920.00 (11,648 usable square feet x $40.00) For Lessor’s Work for each floor, see Section 7.2 and Exhibit “C” attached hereto. Lessee shall be obligated to pay the Final Cost of Lessor’s Work in excess of the applicable Tenant Improvement Allowance for the 4th Floor Premises and the 3rd Floor Premises, as the case may be, as set forth in Exhibit “C”.
Tenant’s Improvement Allowance. Landlord agrees to pay no more than twenty five dollars ($25.00) per rentable square foot for tenant improvements in the Premises, First Additional Space and Second Additional Space, for a total improvement allowance based on 39,378 square feet, which, at $25,00 per square foot, shall be equal to a total tenant improvement allowance of $984.450.00 (the “Total Improvement Allowance”). In the event the tenant improvements for the Premises, First Additional Space or the Second Additional Space exceed the Total Improvement Allowance, Landlord will advance the costs for such improvements, but in no event in an amount greater than $30.00 per square foot (the “Overage Amount”). The Overage Amount will be due from Tenant and paid, at the election of Tenant: (i) within thirty (30) days after notice from Landlord of the Overage Amount, or (ii) by Landlord amortizing the Overage Amount over the remaining term of the Lease, plus 8%, and be payable monthly by Tenant with the Monthly Rent. The cost of any tenant improvements that exceeds $30.00 per square foot shall be the sole responsibility of the Tenant. Any unused portion of the Total Improvement Allowance shall be credited to Tenant in the from of rent abatement, based on the following schedule: twenty five percent (25%) of the unused portion of the Total Improvement Allowance shall be credited to Tenant on the one, two, three and four year anniversary of the Commencement Date, respectively. Any improvements made to the Premises, First Additional Space or Second Additional Space that are required by law, statute, ordinance or governmental rule or regulation shall not be deducted from Tenant’s Total Improvement Allowance. This includes, but is not limited to, expansion of common area bathrooms and installation of additional stairwells or staircases.

Tenant’s Improvement Allowance. Notwithstanding anything herein to the contrary, Landlord shall reimburse Tenant in cash the first $469,404 spent by Tenant in Tenant's Improvements. Such reimbursement shall be made by Landlord to Tenant within thirty (30) days after Tenant's Architect certifies to Landlord that Tenant's Improvements to the Premises have been completed in accordance with the plans and specifications therefore. The Tenant's Improvement Allowance will increase by $95,526 before landlord makes improvement to floor to permit multiple tenants, if Tenant leases the balance of the fourth (4th) floor of the Building pursuant to the provisions of Section 4.1
