Site Investigation and Representation. XXXX acknowledges satisfaction as to the nature and location of the work; the general and local conditions, particularly those bearing upon availability of transportation and access to the site; disposal, handling and storage of materials; availability of labor, water, electric power, telephone, and roads; uncertainties of weather or physical conditions at the site; the conditions of the ground; the character of equipment and facilities needed prior to and during the performance of the work; and all matters that can in any way affect the work or the cost thereof under this Contract. XXXX further acknowledges satisfaction as to character, quality, and quantity of surface and subsurface materials to be encountered from XXXX'x inspection of the site and from reviewing any available records of exploratory work furnished by Owner or included in the Contract Documents. Failure by XXXX to become acquainted with the physical conditions of the site and all the available information will not relieve XXXX from responsibility for properly estimating the difficulty or cost of successfully performing the work. XXXX warrants that as a result of examination and investigation of all the above-described data, XXXX can perform the work in a good and workmanlike manner and to the satisfaction of Owner. Owner assumes no responsibility for any representations made by any of its officers or agents during or prior to the execution of the Contract unless: (1) such representations are expressly stated in the Contract Documents; and (2) the Contract Documents expressly provides that the responsibility therefore is assumed by Owner.

Site Investigation and Representation. The Design-Build Firm acknowledges that it has satisfied itself as to the nature and location(s) of the Work under the Contract Documents, the general and local conditions, particularly those bearing upon availability of transportation, disposal, handling and storage of materials, availability of labor, water, electric power, and roads, the conformation and conditions at the ground based on City provided reports, the type of equipment and facilities needed preliminary to and during the performance of the Work and all other matters which can in any way affect the Work or the cost thereof under the Contract Documents. The Design-Build Firm further acknowledges that it has satisfied itself based on any geotechnical reports the City may provide and inspection of the Project(s) site(s) as to the character, quality, and quantity of surface and subsurface materials to be encountered from inspecting the site and from evaluating information derived from exploratory work that may have been done by the City or included in this Contract Documents. Any failure by the Design-Build Firm to acquaint itself with all the provided information and information obtained by visiting the Project(s) site(s) will not relieve Design-Build Firm from responsibility for properly estimating the difficulty or cost thereof under the Contract Documents. In the event that the actual subsurface conditions vary from the actual City provided reports the Design-Build Firm shall notify the City and this Contract Documents amount may be adjusted up or down depending on the conditions.

Site Investigation and Representation. The Construction Manager acknowledges that it has satisfied itself as to the nature and location of the Work, the Adjacent Development Work to be performed on the Adjacent Property, the general and local conditions, particularly those bearing upon availability of transportation, disposal, handling and storage of materials, availability of labor, water, electric power, and roads, the conformation and conditions at the ground based on owner provided reports, the type of equipment and facilities needed preliminary to and during the prosecution of the Work and all other matters which can in any way affect the Construction Work or the cost thereof under the Contract Documents. The Construction Manager further acknowledges that it has satisfied itself based on City provided geotechnical reports and inspection of the Project Site as to the character, quality, and quantity of surface and subsurface materials to be encountered from inspecting the site and from evaluating information derived from exploratory work that may have been done by the City or included in the Contract Documents. Construction Manager should examine the soil conditions at the Project Site to determine if any special shoring, sheeting, or other procedures are necessary to protect the Adjacent Property during excavation of subsoil materials or during filling of any area(s), or for any operation during the performance of the Work. Any failure by the Construction Manager to acquaint itself with all the provided information and information obtained by visiting the Project Site, will not relieve Construction Manager from responsibility for properly estimating the difficulty or cost under the Contract Documents. In the event that the actual subsurface conditions vary from the reports provided by the Construction, City shall notify the City and the Agreement amount shall be adjusted up or down depending on the conditions.

Site Investigation and Representation. Should the Contractor identify any utilities, structures, etc., which will or may be encountered during the performance of the Work, the Town shall be consulted immediately in order for a decision to be made on the potential relocation or other action(s) to be taken as it relates to the Work. The Contractor shall not purposefully disrupt or disconnect any type of utility whatsoever without first obtaining the prior written approval of the Town or applicable utility owner. Work site(s) may have existing utilities, such as, but not limited to, irrigation, phone, water and sewer, CATV, traffic signals, electrical, and storm sewer. The Contractor shall not purposefully disrupt or disconnect any type of utility whatsoever without first obtaining the prior written approval of the Project Manager.
Site Investigation and Representation. Contractor acknowledges that it has satisfied itself as to the nature and location of the work, the prevailing general and local conditions affecting the North, Central and South Regional Landfills, particularly those bearing upon the impacting availability of water, electrical power, facilities, security, and crew facilities. Furthermore, the Contractor has familiarized itself with the uncertainties of weather and ground conditions at the site(s). Failure by the Contractor to acquaint itself with the physical conditions found at the site(s) and available information shall not constitute an excuse for not properly estimating the difficulty or cost of successfully providing these services.
