Review and Approval of Submittals. Design/Builder shall review, study, and approve, or take other necessary action upon all shop drawings, product data, samples, and other submittals to ensure that the Project will be constructed in a timely fashion in strict compliance with the Agreement. All such submittals shall be reviewed and accepted by the appropriate design architect or engineer as applicable.
Review and Approval of Submittals. 149. Whenever a plan, report, or other submission required by this Compliance Agreement is required to be submitted to EPA for review or approval pursuant to this Compliance Agreement, EPA (in consultation with the States and the Citizen Plaintiffs) may approve the submittal or decline to approve it and provide written comments explaining the basis for declining such approval. Within sixty (60) days of receiving written comments from EPA, TVA shall either (a) revise the submittal consistent with the written comments and provide the revised submittal to EPA with copies to the States and the Citizen Plaintiffs pursuant to Section X (Notices) of this Compliance Agreement; or (b) submit the matter for dispute resolution pursuant to Section VIII (Dispute Resolution) of this Compliance Agreement.

No deviation from, substitution for, or other modification from the Contract Documents shall be allowed by Design/Builder in a shop drawing or submittal without written approval, in the form of a Change Order, from Owner. Design/Builder shall engage in prompt and adequate review of Shop Drawing and other Submittals to maintain the Construction Schedule; Design/Builder also warrants it will use its best independent professional judgment in its review to determine compliance with the Contract Documents.
Review and Approval of Submittals. 3.6.1 Design-Builder shall review and return submittals, including shop drawings, product data and samples, submitted by Design-Build Subcontractor. Design-Builder’s review of submittals shall be only for the purpose of confirming general conformance with the Construction Documents. Design-Builder’s review shall not relieve Design-Build Subcontractor of its responsibilities to perform the Work in accordance with the Construction Documents unless Design-Builder expressly approves in writing any such variance in its response to Design-Build Subcontractor’s submittals. If revisions are necessary to a submittal prior to Design-Builder’s approval, Design-Builder shall inform Design-Build Subcontractor of any such necessary revisions.

The Town shall review certain submittals required by this Contract and shall, without unreasonable delay either: (1) render to the Designer any Approval required by this Contract, or (2) notify the Designer in writing why such Approval is being withheld. The Town shall not unreasonably withhold any Approval, acceptance, or consent required under this Contract. Approval by the Town shall not in any way relieve the Designer from its responsibility for all data, designs, drawings, specifications, area calculations, surveys, cost estimates and other work or materials furnished by the Designer and its Consultants. The Town’s review, approval or acceptance of, or payment for, any of the services furnished by the Designer shall not be construed as a waiver of rights under Contract or any cause of action arising out of performance of this Contract.

In no event shall the review and/or approval of any submittal be deemed or construed to: (i) constitute verification or approval of any specific dimensions, field conditions, or quantities; (ii) constitute a comprehensive analysis and verification that the submittal is free of all errors and deficiencies; (iii) relieve the Contractor from responsibility for any deviation in the submittal from the requirements of the Contract Documents that was not expressly stated in the submittal as being a deviation from such requirements; (iv) relieve the Contractor from responsibility for any error or deficiency in the submittal not within the scope of review and approval;
