Review and Approval of Submittals. Design/Builder shall review, study, and approve, or take other necessary action upon all shop drawings, product data, samples, and other submittals to ensure that the Project will be constructed in a timely fashion in strict compliance with the Agreement. All such submittals shall be reviewed and accepted by the appropriate design architect or engineer as applicable.

Review and Approval of Submittals. ‌ 149. Whenever a plan, report, or other submission required by this Compliance Agreement is required to be submitted to EPA for review or approval pursuant to this Compliance Agreement, EPA (in consultation with the States and the Citizen Plaintiffs) may approve the submittal or decline to approve it and provide written comments explaining the basis for declining such approval. Within sixty (60) days of receiving written comments from EPA, TVA shall either (a) revise the submittal consistent with the written comments and provide the revised submittal to EPA with copies to the States and the Citizen Plaintiffs pursuant to Section X (Notices) of this Compliance Agreement; or (b) submit the matter for dispute resolution pursuant to Section VIII (Dispute Resolution) of this Compliance Agreement.

Review and Approval of Submittals. 3.6.1 Design-Builder shall review and return submittals, including shop drawings, product data and samples, submitted by Design-Build Subcontractor. Design-Builder’s review of submittals shall be only for the purpose of confirming general conformance with the Construction Documents. Design-Builder’s review shall not relieve Design-Build Subcontractor of its responsibilities to perform the Work in accordance with the Construction Documents unless Design-Builder expressly approves in writing any such variance in its response to Design-Build Subcontractor’s submittals. If revisions are necessary to a submittal prior to Design-Builder’s approval, Design-Builder shall inform Design-Build Subcontractor of any such necessary revisions.

Professional/Contractor shall engage in prompt and adequate review of a Shop Drawing and other Submittals to maintain the Construction Schedule; Professional/Contractor also warrants it will use its best independent professional judgment in its review to determine compliance with the Contract Documents.
