The Designer Sample Clauses

The Designer as the representative of the Owner during the Construction Phase, shall advise and consult with the Owner and all of the Owner’s instructions to the Contractor shall be issued through the Designer. The Designer shall have authority to act on behalf of the Owner to the extent provided in the General Conditions unless otherwise modified in writing.

The Designer. The firm appointed by the Owner to be responsible for the design of this Project, who has obtained the relevant qualification certificate for project design.
The Designer must arrange for timely invoicing. In consultation with the client the Designer may charge the agreed fee and costs as an advance, in the interim or periodically.
The Designer. Builder shall not be liable to Owner or otherwise responsible for damage or injury to the work or for additional costs or delays in the performance of the work arising out of or caused by concealed, latent or unforeseen surface or sub-surface conditions: (i) differing from those indicated in the contract documents, or (ii) not specifically disclosed to Designer-Builder in writing prior to the commencement of the work.
The Designer agrees, at its sole cost and expense, to defend, indemnify and save harmless the Owner and the Owner’s trustees, officers, employees and agents against and from any and all liability and claims by or on behalf of any person, firm, corporation, entity, or governmental authority arising from, attributable to or in connection with any breach or default on the part of Designer in the performance or non-performance of any covenant or obligation on the part of Designer to be performed pursuant to the terms of the Agreement or arising from any willful or negligent act or omission of Designer or any of Designer’s contractors, servants, or employees, including, without limitation, any and all claims for injury or death to persons or damage to property.

  • Program Design The County Human Resources Department will operate a Catastrophic Leave Bank which is designed to assist any County employee who has exhausted all paid accruals due to a serious or catastrophic illness, injury, or condition of the employee or family member. The program establishes and maintains a Countywide bank wherein any employee who wishes to contribute may authorize that a portion of his/her accrued vacation, compensatory time, holiday compensatory time or floating holiday be deducted from those account(s) and credited to the Catastrophic Leave Bank. Employees may donate hours either to a specific eligible employee or to the bank. Upon approval, credits from the Catastrophic Leave Bank may be transferred to a requesting employee's sick leave account so that employee may remain in paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury, or condition. Catastrophic illness or injury is defined as a critical medical condition, a long-term major physical impairment or disability which manifests itself during employment.

  • Schematic Design Documents In accordance with the approved Preliminary Design and Construction Schedule and based upon approval of and comments made by the Owner regarding the Concept Design Studies, the Design Professional shall prepare and submit to the Owner Schematic Design Documents, including drawings and outline specifications. These documents shall represent a further development of the approved design concept, providing additional detail and specificity regarding the intended design solution. Typically, all such documents shall be drawn to scale, indicating materials and assemblies, as appropriate, to convey the design intent and to illustrate the Project’s basic elements, scale and relationship to the Site. All major pieces of furniture and equipment to be fixed or supplied by the CM/GC shall be illustrated to scale. (See ASTM Standard Practice E 1804-02, August 2007, Sections 6.3, 8.2 and 8.3 for guidance on information which is generally developed in Schematic Design.)

  • Other Directory Services 73.10.1 Both parties acknowledge that CenturyLink’s directory publisher is not a party to this Agreement and that the provisions contained in this Agreement are not binding upon CenturyLink’s directory publisher.
