Resident’s Responsibility. It shall be a condition of receiving a subsidy that RESIDENT shall warrant and represent to NEWBURY COURT that he or she has not made any gift of real or personal property or imprudent investment in contemplation of the execution of this Agreement or during the term of this Agreement. During such time as NEWBURY COURT shall subsidize RESIDENT’S Fees, RESIDENT shall also, from time to time as requested by NEWBURY COURT, provide NEWBURY COURT with personal financial statements and copies of RESIDENT’S tax returns.

Resident’s Responsibility. Resident’s acceptance as a resident at Brookhaven is based upon information Resident has furnished in Resident’s Confidential Data Application. It shall be a condition of receiving a subsidy that Resident shall warrant and represent to the Community that Resident has not made any gift or transfer for less than fair market value of real or personal property or imprudent investment in contemplation of the execution of this Agreement or subsequent to the submission of the Confidential Data Application. Resident shall also, from time to time as requested by the Community, provide the Community with personal financial statements and copies of Resident’s income, gift, estate and any other tax returns.

We strongly urge residents and or their families to arrange for the appropriate documents to be completed prior to admission for residency. This is to ensure that those who are (or become) incapable of making or communicating decisions about their own welfare or property have someone who can legally make these decisions. The Board of the Ryder Cheshire Foundation strongly believes that some form of written legal instruction needs to be in place for all residents. Residents are encouraged to also have a Will in place.

As a condition to having the Entrance Fee credited against fees due Operator by Resident under this Agreement, Resident must represent that he or she has not made any gift of real or personal property in contemplation of the execution of this Agreement.
