Presentation of Grievances. 9.16 Where the Union wishes to present a grievance, an authorized representative of the Union shall transmit the grievance to a supervisor or local officer in charge who shall forthwith:

Presentation of Grievances. Step 1. All grievances shall be presented to the appropriate Xxxx in writing within thirty (30) days of the act, omission, or commencement of the condition on which the grievance is based, or after the date on which the member knew or reasonably should have known of such act, omission, or condition, if that date is later. In no event, however, shall grievances be presented more than 120 days after the act, omission, or commencement of the condition on which the grievance is based. The grievance shall be presented on the grievance form (Appendix A) and shall set forth the act, omission, or condition on which the grievance is based, the date thereof, the specific provision(s) of this Agreement which is in dispute, and the remedy sought. Upon receipt of the written grievance, the Xxxx shall meet with the grievant and shall render a written decision. The parties may also elect to resolve the grievance informally during this period, but the Xxxx’x decision shall, in any case, be rendered within 15 days. If the matter being grieved relates to an act or omission by a Vice President or the President, the grievance may be filed at Step 2, but the manner provided at this step.

Presentation of Grievances. All grievances shall be presented as soon as practicable after the occurrence upon which the same is based, but in no event later than five (5) working days if the same is a Dismissal Grievance, fifteen (15) working days if the same is a Wage Grievance, and fifteen (15) working days if the same is a Grievance arising for any other cause. The failure to submit a grievance within such periods shall constitute a bar to further action thereon. If it is determined under the Grievance Procedure that an adjustment in wages is appropriate, such adjustment shall be applied retroactively to the date of first occurrence, provided that such date is not more than thirty (30) days prior to the date upon which the complaint was presented. Dismissal grievances may be presented at the Third Step and the dismissed employee may be present during all such procedures.
