Failure to Submit. 4.4.3.1.1. If Seller has not submitted the Annual Fuel Attestation and Verification of Fuel Source and Delivery by the Annual High Hazard Fuel Attestation Deadline, Seller shall be deemed to have failed the Fuel Resource Requirement and the High Hazard Fuel Requirement during such Calendar Year and Seller shall be subject to an Event of Default pursuant to Section 13.2.2.15.
Failure to Submit a) Failure of a Member who is eligible for an annual increment to submit the annual report by the specified time limit will result in the delay of the decision whether to award or deny the annual increment until such time as the report is submitted. If awarded, the payment of the appropriate monthly portions of the increment shall be effective on the first of the month following submission of the report or July 1 immediately following the due date, whichever is later.
Failure to Submit. Application In the event the Subcontractor does not submit to the Contractor a request for progress payment as directed, then the Contractor may, at its option, include in its request to the Owner for progress payment for Work performed during the preceding payment period, such amount as Contractor may deem proper for the Subcontract Work for the preceding payment period and the Subcontractor agrees to accept such approved portion thereof in lieu of the progress payment based upon the Subcontractor's estimate.
Failure to Submit. Sealed Bid. Iomed shall, for a period of one (1) year from the expiration of the respective Offer Period, be free to sell the Offered Assets (i) at a price not less than the Floor Price determined by the Escrow Agent in accordance with this Section 7.02, in the event that the Fourxxxx Xxxled Bid is less than the Iomed Sealed Bid by more than One Hundred Fifty Thousand Dollars ($150,000 U.S.) or (ii) at any price, in the 16 20 event that Fourxxxx xxxls to submit a Fourxxxx Xxxled Bid prior to the expiration of the Offer Period. Any prospective sale, conveyance or other transfer of the Offered Assets which has not been consummated within such one (1)-year period shall become subject again to this Section 7.02.
Failure to Submit. If Seller has not submitted a Quarterly Fuel Attestation by January 30th of the next calendar year, or within 60 days after Fuel Switch Effective Date, Seller shall be deemed to have used zero percent (0%) High Hazard Fuel during such Calendar Quarter. If Buyer does not receive Seller’s Quarterly Attestation with its monthly invoice for the 3rd, 6th, 9th or 12th month of the calendar year, that month’s invoice will be deemed incomplete, and non-payable by Buyer until the Quarterly Attestation is received.
Failure to Submit. 5.12.9.2.1. If , f or any month during the Delivery Term, Buyer does not receive Seller’s Multi-Fuel Report by the Monthly Multi-Fuel Report Deadline, such month’s invoice shall be deemed incomplete and Buyer shall not be required to pay, and no amount shall be due or owing under, that incompete invoice. Upon Xxxxx’s receipt of Seller’s Multi-Fuel Report, the previously deemed incomplete invoice shall be paid in the following monthly invoice cycle subject to and in accordance with Section 2.7.
Failure to Submit a Claim Notwithstanding any other provision of this Section 12.0, if Seller fails to submit a termination claim within the time period set forth above, Seller shall be barred from submitting a claim and Boeing shall have no obligation for payment to Seller under this Section 12.0 except for those Products previously delivered and accepted by Boeing.

If Buyer does not receive Seller’s Quarterly Fuel Attestation with the applicable monthly invoice for March, June, September and/or December of each the Calendar Year, such month’s invoice shall be deemed incomplete and Buyer shall not be required to pay that invoice until the Quarterly Fuel Attestation is received. Upon receipt, Xxxxxx’s invoice shall be paid in the following monthly invoice cycle subject to Section 2.7.]
Failure to Submit. Any company which does not desire to offer a submission should submit to the City a letter stating a reason for not submitting and whether the company desires to be retained or removed from the City’s list for future solicitations.
